Is West Virginia an illegial State?

    I wasn't around back then, so I don't know. Regardless of how the state was formed, it is now recognized as one of the official 50 states.

    If we're not really a state, then I want to stop paying taxes here!

    But was West Virgina Statehood Constitutional?

    it granted permission to itself on 
    May 13
    1862to form the state of West Virginia.
    By not requiring the approval of Virginia, the United States was saying that secession was legal. Hmmmmm

    But was West Virginia actually the Restored govt of Virginia?

    Since Virginia seceded from the union and those in what became West Virginia didn't go along with it, but rather stayed loyal to the union one could argue that they are the true legitimate Virginians.

    Agreed - but then the US had no right to fight to "Preserve" the union

    It would be an interesting argument if WV decided to pull out. They could "confess" that their admission was illegal.

    Hmm would they confess to the Pope? :laugh: or to the King of England (head of the Anglican church.
