Monday marks 50th anniversary of Loving decision on interracial marriage

    Monday marks the 50th anniversary of the U.S. Supreme Court's landmark decision in Loving v. Virginia, which effectively struck down bans on interracial marriage in Virginia and 15 other states.

    The unanimous court ruled that Virginia's anti-miscegenation statutes violated the 14h Amendment to the U.S. Constitution, which guarantees equal protection of the laws.

    In delivering the court's opinion on June 12, 1967, Chief Justice Earl Warren said: "Under our Constitution, the freedom to marry, or not marry, a person of another race resides with the individual, and cannot be infringed by the state."

    Another abusive decision based on rights not guaranteed under the 14th amendment. There is no right to marry under the Constitution. Period.

    So what are you against? The right of people under the law to have their marriage recognized, or the right of people of different ethnicities to marry and have it recognized under the law?

    There is no constitutional "right" to either one, no matter what your ethnicity. Period.

    At least , there wasn't until the Supreme Court invented it out of thin air via the 14TH Amendment.

    So you are opposed to the government recognizing marriage? That's an extreme position that undermines all kinds of other laws regarding citizenship, inheritance, ownership of property, etc.

    I used the term "recognized" in both instances and you said there was no right to either one being recognized.

    What are you trying to say about marriage?

    While I have long thought the government should not be in the marriage business -- including all of those measures passed to "protect" marriage -- it IS important for the government to RECOGNIZE the reality of marriage in terms of citizenship, inheritance, ownership of private property, custody of children, etc. So there is a sense in which marriage definitely is a government issue.

    The government (local, state, and federal) has no business telling couples that they cannot marry someone of a different ethnicity. That's what the Loving v. Virginia decision was about. It was a proper application of the principle of equal protection under the law for all citizens of the United States through the 14 Amendment.

    You can say that, or wish it, or write legislation to make it so...

    But currently it is. It's regulated at every level, from age of consent to inheritance rights or divorce proceedings.

    Quote the constitutional right to marry anyone at all.


    Another invented "right" of the 14th Amendment gave women the "right" to kill their babies, to the everlasting shame of the entire nation.

    Marriage was not mentioned in the Constitution since it was traditionally a state issue. However, since the 14th Amendment makes the persons of all states citizens of the United States (it federalizes citizenship), it also extends the protections of the Bill of Rights to all persons in all states. Therefore, a citizen in a state has a right to equal protection under the law making state laws against persons marrying other persons on the basis of differing ethnicity unconstitutional.

    This is hardly controversial, unless you oppose "interracial" marriage.
