Valid loophole?

No. Biblically speaking, the one passenger is with child, as yet unborn to occupy a second passager space, or seat.

I don't buy it. Eat some pickles and peanut butter and get in the right lane.

So cited for not properly restraining that second passenger?

I find this claim (a women with child can drive in a lane designated for two persons) to be proper. Does scripture treat the pre-born as a "baby?" Yes. If a person causes the loss of a pre-born baby, is the penalty the loss of their own life? Yes.
Someone said that if a slow baseball catcher raced a pregnant women, he would come in third. :)

That's an interesting technicality. Persons versus seats occupied. It could depend on how the law reads and/or how a court interprets it.

From the story, the Texas penal code says “an unborn child is considered a person as every stage of gestation”, the the transportation code doesn’t recognize the unborn child.

So, yes she has a point. It will be interesting to see this go through the courts.

There is also implications for the tax code. Should an unborn child be considered a dependent?

peace to you

Now the intention of the law is that the other passengers are duly licensed drivers - who would otherwise by driving.

So, a car full of children wouldn’t count? Interesting.

I guess it will all depend on the exact language of the law concerning the use of those lanes.

North Texas HOV Lanes

Interesting point -
So a car full of kids - By Mrs. Jones taking 6 kids in her car to the roller skating rink means that 5 moms are saving gas!

This should be a very interesting case!

FWIW
The link above also states:
"Note: Hybrid vehicles with single occupants are not allowed in HOV lanes".
Hmm, I wonder why???
