17 States Take Obama to Court: You Are Trampling the Constitution

A coalition of seventeen states joined together today to file suit against the Obama administration, arguing that President Obama swept aside the constitutional limits on his power and violated his constitutional obligation to “take care that the laws be faithfully executed” when he moved to unilateral dismiss enforcement of the immigration laws against 4 million illegal aliens.

“This lawsuit is not about immigration,” said the complaint filed in the U.S. District Court for the Southern District of Texas. “It is about the rule of law, presidential power, and the structural limits of the U.S. Constitution.”

Texas Attorney General Greg Abbott, who is the governor-elect of Texas, explained the states’ argument.

“The President’s unilateral executive action tramples the U.S. Constitution’s Take Care Clause and federal law,” Abbott said in a statement. “The Constitution’s Take Care Clause limits the President’s power and ensures that he will faithfully execute Congress’s laws – not rewrite them under the guise of 'prosecutorial discretion.’”

Don't know what this will do but here in Houston the damage is done. There are so many illegal running around that most place post in Spanish and English. The local Tmobile "for example" has all Hispanics working there to deal with the non English speaking invasion. Many whites, blacks and Asian Americans cannot work at local places unless they are bilingual and guess what.....we were not taught Spanish as a nessasary in school to survive here. There is a reason the law makes them learn English to become a citizen BUT lawlessness has a price thanks to the government and the Hispanic chamber of commerce "compassion" we the people got thrown under the bus.

The problem with law suites like this is that it will take years to resolve, and by then this will be to the point that the damage can't be undone.

You can't count on the GOP to do their job so it falls to states to do what has to be done.

It turns out that Obama has turned to Richard Nixon as his spiritual mentor:

As Nixon stated in 1977 in an interview with David Frost:

"If the president does it, that means it's not illegal."

Waste of time. The Federal Government has sovereign immunity in cases like this.

If there is a trampling of the Constitution taking place, it would , in this instance be by mostly a bunch of partisan states attempting to do something they know they have no grounds for doing.

If they want to sue for some sort of tortious liability where they think the government has brought harm to their state, that's one thing.

But to file suit because you think the President is trampling the Constitution? Sit down somewhere. There are checks and balances to deal with that and it's not through states filing suit.

With all due respect, Zaac, I fear that someday an illegal might take your job of posting here on the BB in support of the Dems. It is a low-paying job, right?

Apparently the AG's of 17 states should have called Zaac because after all their education and experience Zaac knows far more than they do. Whoda thunk?

Man please. Everybody knows this is more symbolic than anything else. They know this isn't going anywhere just like everybody knows suing over EOs isn't going anywhere.

The GOP has taken to blowing a lot of smoke but never really doing anything. Wonder why that is?

Where's Poncho?

Woopty Dooo. The President trampled on the Constitution. They have no grounds for a suit against him trampling on the Constitution. If the 17 have a common item where he acting on behalf of the federal government have brought harm to their states, then they have ground.

But they lack standing to bring a suit against the President for trampling the Constitution or breaking the law.

That's why Congress impeaches and not the states.

Anywhoooo...

He better start learning Spanish to keep up because the McDs here only like Spanish speaking coworkers and would fly over his head.

Who said anything about illegalities? They lack standing to bring suit against the President over his not adhering to the Constitution if he isn't.

With all due respect, your fears are your own and won't dictate me continuing to tell the truth.

I don't know about the rest of the states, but Texas has good legal standing as an aggrieved party.

Gregg Abbott has already won 5 lawsuits against the feds on behalf of Texas. No one in any other state even comes close.

Question: If he won....what would be the out come? Obama faithful to keep the laws? Seems like a dream.....not the "dream act" my I say.

Nope. They again have no standing to make him keep the laws. That's what Congress is supposed to be for. And it's already been shown that states can't make the federal government keep federal law no matter how much they whine.

If they've got a tort issue or some sort federal employee issue that has brought harm to their states, then they have standing.

But making the President abide by "their" idea of what the Constitution says he can/cannot do, is a waste of time. They have no standing.

I have no idea. I don't know what he sued for other than constitutional performance.
