It can't. The liberty remains the same and there shall be no infringement regardless. Democrats see things in the Constitution that aren't there (abortion) and ignore what is actually written. They also do not subscribe anymore to the three distinct and equal branches of government. They now see the Judiciary as some sort of super legislature that is given more credence than the other two, where they can get things written into law that they can't get through the Congress. Even rock solid powers of the Executive Branch as written in the Constitution are subject severe scrutiny.
