Bush Picks Miers for Supreme Court Slot

    Looks like another great pick to me. Apparently, Ms. Miers believes that the legislature should legislate and the courts should adjudicate.

    No one should know ahead of time how a justice or a judge will rule on a case so that we have an impartial judiciary that looks at the facts and then applies the constitution and the laws to it.

    Yep. The hardcore conservatives are not happy with this nominee.

    I disagree with them on this nominee just as I will disagree with any hardcore liberal opposition.

    how can a born again christian vote/support one that is for the torture/murder of babies.

    1) Where is the evidence that she is a baby killer or even pro-abortion? (An honest question since I haven't seen any evidence either way. The Operation Rescue guy's guilt by association does nothing but make him look stupid. Especially since she would have last been at SMU about 20 years ago.)

    2) If she is genuinely a strict constructionist then it won't matter what her opinion on abortion is. She will be an ally in overturning Roe v Wade since that is a decision rightly dealt with in state legislatures.

    Hardcore conservatives will be unhappy with anyone left of Lou Sheldon, so their disappointment is neither of concern nor of surprise.

    It bothers me some not to know anything about her opinions and phisophy.

    But what bothers me most is that she seems to be a one dimensional person. She has no family and her list of pasttimes on the profile I saw had one entry: jogging... a non-social activity.

    She comes in earlier and stays later than anyone else. That says she is a workaholic... and suggests that she is possibly a micromanager who doesn't trust anyone else's ability.

    She listed off quite a few family members this morning:

    I know her brother, so she does have family. I believe she also has another brother I have not met.

    I don't know anything about her and neither it seems does anybody else.

    If Bush appoints anyone, either Roberts or this lady, that votes to uphold Roe Vs. Wade, Homosexual rights, or to interfere in any way with the Christian religion he would be making a major mistake. The backlash from Christians would come close to destroying the Republican Party at all levels.

    OTOH, if the appointee votes to reject aspects of Roe that violate the Constitution, or overturn rights of homosexuals beyond those granted by the Constitution, or refuse to interfere with the Christian religion to the point where the it violates the Constition, then Christians, as well as all people, should denounce that same apointee.

    Look, I care only about whether an apointee will make ruling solely based on law, whether I as a Christian, or whether the apointee as a private person, agree with those laws or not.

    The president campaigned on appointing strict constructionists. He certainly has done so on the lower courts. He knows Ms. Meirs quite well, unlike his dad who appointed Mr. Souter. Is there any reason not to trust the president on this appointment? If so, what is the evidence based on his previous court appointments? Notice that I said "evidence", not "supposition".

    Anyway, I posted this response to Ken Mehlman when he e-mailed me asking for money and support for Miers:

    That's where I stand. I do have a litmus test and I want to know how she matches up to it.

    Someone who wants to a nominee to announce ahead of time that he/she will vote to overturn certain decisions instead of being willing to listen to the arguments before making a decision. It is just as wrong for the Right to want a partial judiciary as it is for the Left to do so.

    Litmus tests on the Right are just as wrong as litmus tests on the Left when it comes to attaining an impartial judiciary.
