Church sued for $2 million over dramatic youth service
    2003-06-13
    by Anna C. Irwin
    of The Daily Times Staff

A $2 million lawsuit has been filed in Blount County Circuit Court against a Blount County church, the pastor, the youth director, two deacons and several other church members.

The suit was filed by Knoxville attorney Herbert Moncier for John and Jane Doe, plaintiffs who chose not to reveal their names in the suit. They are suing individually and on behalf of their teenage daughter Janie Doe.

The suit claims the girl suffered personal injuries as the result of ``a dangerous, cult-like event that was unlawfully and deceptively conceived, sponsored, promoted and supervised by Forest Hill Baptist Church, its pastor, its deacons, its youth director and several of its members.''

Forest Hill Pastor Harry Sherrer said the event referred to in the suit was designed to help young people in the church learn more about and better understand the persecution of Christians in other parts of the world.

Thanks for sharing that. Of course, we are really only getting one side of the story here, but if the events that have been retold by the girl have any truth to them, I can understand why they are upset. Certainly anyone with some psychological or physical problems would have difficulty with this type of experience. I wonder how much the youth and their families were told about what would happen beforehand...to read this it sounds like they knew very little.

We know that people suffer and are persecuted around the world for the cause of Christ...but I would be very careful of how we teach that. I don't believe this was a responsible way to get the message across, just as I would not agree that the concpt of "hell house" or "judgement house" are the best teaching tools either.

Concerning the lawsuit...more is always asked for than should be awarded. Does the family have a right to sue? I believe yes. Do they have a right to 2 million? Certainly not. That is a ridiculous amount for such an incident.

Charles, I also had the exact thought about this being similar to those horrible "Hell House" displays some churches put on at Halloween.

Preaching the Word, verse by verse, and letting people know that God expects us to be disciples? Sometimes staying 'way past noon? Taking notes? Making application to your life? Are you kidding?

If, and I say if these allegations are true, this church needs to seriously consider overhauling their youth program.

If this incident had involved my daughter, I would be very upset. I might even consult a attorney myself.

Hey wait a minute folks, we are all incorporated right? We have limited liability and the big insurance companies should come to the rescue! They will probably seek help through the "prestigious" firm of "CLA" and CLA will print this up on a flyer and send it out all over the country to recieve more tax deductable benefits to go and help this church. When are we ever gonna learn? Remember Esther, she had no special security in the court of the king. These churches will learn very slowly to get back to preaching the gospel and get out of their league with Gibeah.

    Thanks -------Bart

BTW.....a church that is not holding hands with the state, what we call a Lordship church, cannot be sued. We all used to be unregistered churches and the 501-C (3) church is the new kid on the block.
Give me that old time religion, its good enough for me. Lawsuits are common fruit of the nature of the Beast. No pun intended.

    Thanks -------Bart

    Bart,
If a church is incorporated, a person can only sue so many people. If a church is not incorporated, they can take a membership roster and sue everyone on the list.

Since I live just up the road from this, I'll be keeping an eye on it.

Bro Tom thanks for the post but, that is what is normally considered to be true. You must understand that one main theme of Law Schools today is teaching how to break incorporations and sue past the veil of limited liability. A "Lordship" church in its legal status has nothing to be "joined" to for a lawsuit to be filed against. It simply does not exist in the eyes of the court. If someone files suit or tries to.... they could not find anyone to file against within statuatory law.

    Thanks -----Bart

This Church broke these parents trust. If it were my kid, I would incredibly angry and would definitely sue. These people would never be allowed to be around my kid again. They should all go to prison.

People can and do just what you say here. They find people to sue...it's called the membership list.

    Joseph, all..

Let's remember we are rushing to judgement here. We should not do this. This may or may not be the warp and woof of the actual events.

If what this girl says is true, every single last one of them should go to prison. Every deacon, pastor, and staff member should be fired and go to prison.

Bro Tom I appreciate your patience in speaking to me on this issue and I really appreciate your advice to the Brother to not rush to judgement and I ask you to not do the same.

First of all we have no membership list. Secondly, an incorporation has lost its "right" to privacy as stated by the US Sup Ct and must offer up any and all records when supoenas require so. A Lordship church has not relinquished or turned over its right to privacy and cannot be required to do so.

I know it is hard to work with hypothetical situations but lets try. Person comes to church and falls on property and leaves premisis and suit is filed. It lists "shiloh" Baptist Church and Pastor and Deacons.

There must be a "legal" entity to join to the case. If no C (3) or unincorporated association then that is a wash out as far as the suit is concerned.
Then the Pastor is called. Is he personally responsible? Is the property his? Who does it belong to? It is titled in the Name of The Lord Jesus Christ. Will the court call Him? Should the court find him solely responsible or are two responsible or three or the whole body? Will they call the whole body into court?
Scripturally speaking, if there is negligence involved by the church then the church is responsible and the Pastor should lead the church in damages and restitution. It will not be by the order of the court though.

    Thanks ------Bart
