The criminal case against Gen. Michael Flynn for lying to FBI agents was incredibly weak. At the time, I assumed that the charges against him were based on an audio tape or court reporter’s transcript of his interview. I wrote that the transcript should be made public so that we can all judge whether anything he said was actually untrue. While Flynn ultimately pled guilty to a single count of lying to a federal investigator, he has also said publicly that he pled to that single charge because the criminal investigation was rapidly bankrupting him.

In fact, there is no verbatim record of what Flynn said to the agents who interviewed him. Consistent with normal FBI practice, as I understand it, there is no recording or transcript. Rather, the agents who conducted the interrogation summarized what Flynn said in a form FD-302. Is this summary of what Flynn (or any other witness) said accurate? Who knows? Are nuances lost? Undoubtedly. Is much of what the witness said, that may have mitigated the claim that something he said was false, omitted? Of course.

In my opinion, the likelihood of getting a criminal conviction of General Flynn on the basis of a Form 302 was vanishingly small. If the government can’t prove what Flynn said–exactly–there is no way they can convict him of what amounts to perjury. So I find Flynn’s statement that he didn’t do anything wrong, but pled guilty to a single count to preserve what little net worth he has left, to be credible.

........Everything that happened to Flynn, happened for one reason only: It was to target Trump and it’s still ongoing.

This has led to a slew of new evidence against the bureau and validation of alleged misconduct by its FBI agents, some of which had been slowly trickling out since former senior Obama Administration officials began targeting Flynn openly in January, 2017.

Further, she reveals concrete evidence that the government is still holding onto significant Brady material that would fully exonerate her client. It would also hold responsible senior federal law enforcement and Justice Department officials who distorted facts and leaked lies to the media about the three-star general.

Because of this, Powell is demanding that the court require that the government produce all evidence related to Flynn. She is also urging the court to hold prosecutors in contempt and “dismiss the entire prosecution for outrageous government misconduct.”

The Evidence
The most significant evidence against the FBI validated in Powell’s brief was the circumstances surrounding Flynn’s first interview with the FBI on Jan. 24, 2017 and the manipulation of the interview report, known as a 302, from that interview. The interview was conducted by now fired FBI Special Agent Peter Strzok, whose texts messages later revealed he was vehemently anti-Trump and current FBI Special Agent Joe Pientka, who has never spoken publicly on the matter. In December, 2017 this reporter revealed that it was Strzok who had interviewed Flynn and that the interview itself was a set-up.

Powell noted that “on February 10, 2017, the news broke—attributed to ‘senior intelligence officials’—that Mr. Flynn had discussed sanctions with Ambassador Kislyak, contrary to what Vice President Pence had said on television previously.”

Then, according to documents, “overnight, the most important substantive changes were made to the Flynn 302.”

“Those changes added an unequivocal statement that ‘FLYNN stated he did not’—in response to whether Mr. Flynn had asked Kislyak to vote in a certain manner or slow down the UN vote. This is a deceptive manipulation because, as the notes of the agents show, Mr. Flynn was not even sure he had spoken to Russia/Kislyak on this issue. He had talked to dozens of countries.”

On Feb. 13, 2017 Flynn resigned as National Security Advisor.

General Flynn, a Democrat, knew that Obama was tapping Trump's communications. He told Trump. That was why he was the object of the wrath of the corrupt and dirty FBI. The call to the Russian ambassador was standard for an incoming administration. The FBI tapped that call and so they know that nothing was amiss. They framed General Flynn because they knew that they had broken the law with their dirty FISA judges and their kowtowing to Obama because they wanted Hillary elected so that they would get the cushy government jobs that the Dems had promised them when Hillary won. The FBI knew exactly what was said on the telephone call. They are lazy so they tried to trick a hard-working busy General Flynn over some sort of minor item. That is just how dirty and crooked the FBI is.

The fact was that Hillary lost and the FBI could find nothing illegal about what Trump had done. Republicans had never liked Russia since FDR cozied up to Stalin not just for military advantage but because of communists in the FDR administration. So the idea that Trump would have something to do with Russia was a reflection of the fact that Obama made a deal with Russia to withdraw missiles from Eastern Europe in exchange for no Russian problems until after the election of 2012. And Hillary presided over a deal to sell 20% of American uranium mines to Russia on the quiet as well as accepting 145 million for the Clinton foundation and Bill's getting half a million for a speech to the Kremlin.

Trump won because Hillary is a crook and Trump got tons of free publicity from the media and was able to turn the free publicity into large crowds everywhere he went.

No, General Flynn did nothing at all wrong. This whole thing was about Democrat politics.

I think so, and they may pay for it.

Durham is a serious non-partisan prosecutor.

We'll see.
