Ken Lay dead

    I pray for the family. Death is never a good time for most families - so few really can celebrate the glory of someone going to eternity.

    ==I heard someone say that Mr Lay has escaped justice. May I say that there is no such thing as escaping justice? The Bible is clear, "it is appointed for me to die once and after this comes judgement" (Heb 9:27). Hebrews 10:31 says, "it is a terrifying thing to fall into the hands of the Living God". Revelation 22:12 says that Jesus will "render to every man according to what he has done". So I can assure everyone that Mr Lay has not escaped justice, nobody will.

    I do pray for Mr Lay's family, that this terrible situation will be used to draw them to Christ.

    Wow. That takes all the fun out of gloating his conviction.

    Martin, don't you think His mercy will spare Lay His justice?

    To quote Jesus Himself...

    "unless you repent, you will all likewise perish" Luke 13:3-5

    So will God's mercy spare Lay? If Lay did not repent and turn to Christ as Lord...no.

    Agreed. We will all give an account to Him. Some of us will be covered by the Blood of Jesus Christ if we have accepted Him as our Lord and Savior and we will receive Eternal Life instead of eternal damnation.

    God already granted Mr. Lay "mercy" through the shedding of the atoning blood of His Son, Jesus Christ, on the Cross of Calvary - a Gift of His Grace. It was Mr. Lay's choice whether or not to receive the Gift.

    Well, now I feel sick to my stomach.

    You all don't know how many times that I have felt scorn in my heart over this man. Never once did it cross my mind to pray for him. I was too busy being angry at him.

    To be honest, it never occurred to me to pray for him, either. I was so disgusted with the fact that Martha Stewart went to prison over something far less damaging than what Ken Lay did, yet he walked around free.

    According to an interview in 2002 with the Wittenburg Door, Ken Lay stated he was a Christian and felt that God was active in his life.

    I believe we all need to pray for his family at this time. It's difficult enough to lose someone, but esp. under such circumstances.

    A Limey lawyer asks: why the large gap between his conviction (May) and sentence (which was to be October) and why was he granted bail instead of being remanded in custody pending sentence given that a lengthy custodial sentence was inevitable? Over here, it's normally just a month max between conviction and sentence ( to enable the probation service to do a pre-sentence report eg: "Ken may be a greedy lying so-and-so but hey he hosts great parties and he's really done a lot for Houston so, pretty please with sugar on top, don't lock him up") and someone like Ken would have been locked up in the meantime.

    I believe he was not remanded because he has posted bail. He passport was revoked so he could not flee. Months between conviction and sentencing is not unusual. It depends on the case and the case load of the court.

    Martha Stewart also walked around free until her sentencing. So to compare Ken Lay to that, you see that he got the same thing she did.

    It is sad that he died. It reminds us of the brevity of life.

    It also depends on how much money a person has in their bank account!

    I would imagine that people with more money in their bank account are more likely to be remanded since they have the means to flee, while poor people don't.

    Once you have posted bail, I think you are free until sentencing.

    Except that people with mucho money are more likely to have decent lawyers working on their behalf...

    I think it may also have to do with filing an immediate appeal.

    Again, people with money are more likely to make bail.

    Neither of which affects the status of a person in between verdict and sentencing, that I am aware of. These are pretrial and trial issues. Not post trial issues.

    Which was not the issue. Terry was questioning why he was out after the verdict insead of in jail. He had enough money to make the bail, so he is free.

    BTW, before sentencing there is no reason to put him in jail. He has no sentence for which to be jailed until the sentence is passed down.

    I realized that I simply didn't know, not having had any experience with criminal courts. I found this pamphlet on Federal Crime Timeline (linkie - pdf).
    So, if 90 days is usual, then Lay got extra time to prepare.

    Over here, if a custodial sentence of some kind is a foregone conclusion, then the defendant is normally remanded in custody, whether or not they can post bail, simply because in nothing else time spent on remand counts towards their sentence and they might as well get started.

    The guy is dead. If we got nothing good to say about him except how much of a sinner he is (and by the way, others far worse than he has been are with the Lord, literally, at this moment), then we'd best shut up.

    Not that there's a complete moral equivalence of course, but would you say the same about Hitler and Stalin?
