Jeremy Mayfield won the injunction so that he could have raced tonight. However, he didn't show up at the track and people wonder why he even got the injunction. Does this really have to be explained? I'm no lawyer, but it seems to me that getting the injunction set a precedent for what's coming next.

Brian France says Nascar's drug policy is thorough and fair. I think that's baloney. A real drug policy provides a list of banned substances. Nascar's does not.

This is what Dr. Gary Wadler of the World Anti-Doping Agency had to say about Nascar's drug testing policy.

You can find the above quotes in the article here. Dr. Wadler made those statements on ESPN's Nascar show soon after Mayfield was originally suspended.

Kyle Petty talked about how both sides get kudos here for sticking to their story. No, Kyle. If the drug test provided a false positive, which is clearly a possibility according to what I've seen, then Nascar has ruined Mayfield's career. And, if the drug test was true and Mayfield did take meth, then Mayfield's perjured himself in federal court and has ruined his life all by himself. Let's save the kudos until we know for certain who should get them.

Did you hear Mayfield's post-case comments? He sounded like he was thanking his sponsors. "I just want to thank the law firm of XYZ...the lawyers stayed up all night (sic) preparing the briefs and researching the cases" I fully expected any minute for him to thank the briefcase makers at Samsonite. It was like something out of a cartoon.

Petty could not be more wrong. NASCAR's potemkin drug policy is not praiseworthy at all. I can't blame Mayfield for going to court, but if it comes out that he is indeed guilty as charged, you're right that I'd imagine perjury charges could come up since he isn't a politician or talking about sex, since that doesn't count :tongue3:

So, Mayfield failed another test. And his stepmother filed an affadavit about her personal knowledge of his drug use. These are not good things.

Terry Blount hits all the right notes in this piece about the 2nd positive test.

I'll buy one false positive, but I won't buy a 2nd one. Jeremy can call his stepmother all the names he wants to, but the 2nd positive test is far more damning than anything she says.

Nascar has come away vindicated and what I hope happens is that, instead of crowing about their win, they use this to shore up the obvious holes in their drug testing policy. It's time for Nascar to get their drug testing policy in line with what other sports are doing. They should have a policy that doesn't even allow for the casting of doubt that Mayfield was able to do.

When Manny Ramirez tested positive, there was never a doubt about the test result. When Shawn Merriman tested positive for steroids, there was never a doubt about the test result. When Josh Howard tested positive for marijuana, there was never a doubt about the test result. Nascar needs to be in the position so that when Jeremy Mayfield tests positive for meth there should be no doubt about the test result.

I would hope that dirty socks are tasty, for it appears Jeremy Mayfield opens mouth; changes feet.

Interesting twist in the Mayfield story. I'm not sure what to make of this one.

    How is this possible?

Somebody is clearly lying and I really want to be on Jeremy's side in this.

This bothers me that Nascar's tests are the only ones that have come back positive. What I think would be very good for Jeremy's side is if his tests were done at different labs that have nothing to do with one another.

The other thing that bothers me that nobody in the media has mentioned is what a meth addict looks like. Go here and check the bottom of the page to see what a 10 year meth addict looks like. Then, go here and see a current pic of Jeremy. That pic of Jeremy does not look like a meth addict to me. I find it impossible to believe that Jeremy could be a 10 year meth addict and look the way he does.

After the 2nd test came back positive for meth, I started to think that Jeremy's the one who is lying. However, the pendulum has swung back and I don't think Jeremy's lying. I'm not convinced that Nascar is lying either, though they could be. A good friend of mine once said, "Never assume malice when incompetence will do." So, rather than assuming that Brian France and Nascar is out to get him, I'm going to assume that Brian France and Nascar are incompetent.

    That's where I come down.

Why would NASCAR go after Mayfield? I can understand him being a marked man now, but not two months ago. NASCAR has no credibility here. None. It takes some positives proven positive to get some validity. Either NASCAR gets this right, and quickly, or they'll never be able to make anything stick ever. And the last thing we need is someone high going 190 at Talladega.

NASCAR can't kick the football. They're Charlie Brown, and the logical world keeps pulling the football away. See what happened to Indy if they want to see what can happen to a sports dynasty in this country. A perfect storm is brewing, and NASCAR has a 50 cent umbrella and a broken vane. It doesn't look good.

    More fuel for the fire.

This pretty much seals it for me. I think Jeremy's innocent and I think Nascar has a badly flawed testing system. I think that if Nascar continues to maintain, in the face of this new affadavit, that Jeremy is a meth user, they're going to look like bigger fools than they already do.

In all of my posts and rants about Nascar, I think the #1 thing I have posted about is the fact that Nascar doesn't have as much credibility as they think they do. Whatever little they have left will be gone

I don't think it's possible to overstate the credibility hit that Nascar's going to take.

Yeah, but.... Jeremy sounds like he's really making some wild charges in all this. He's gonna sue his step-mom, NASCAR spiked his test. For me Jeremy has had a credibility problem for quite a while. Penske let him go, though I don't remember the circumstances, Mayfield left on bad terms. Evernham let him go. I don't think Evernham wanted to because Mayfield was a very consistent driver for that team. But Mayfield seemingly got very jealous of Kahn's success and fantasized that Evernham was out to get him. The kicker for Evernham was when Mayfield "layed down" at Indianapolis and intentionally ran extremely slow laps. Mayfield has a history of not being able to get along, fantasizing about how people are out to get him, then making wild charges. This episode seems like more of the same and it seems consistent with the paranoid behaviour of a person who has something to hide.

I don't think anybody ever told Jeremy the adage that my friend told me. He thinks somebody's out to get him, but the reality is that Nascar has a badly flawed testing system and that flawed testing system produced 2 false positives. Nascar's incompetent, not malicious.

I don't remember exactly why he left Penske, but he was released by Evernham after he criticized the owner for not being at the track because of the attention he was giving Erin Crocker. Evernham later admitted to an affair with Erin.

I'm not about to say that Jeremy's a saint, but I do think he's innocent of using meth.
