Man says hold the cheese, claims McDonald's didn't, sues for $10 million

A Morgantown man, his mother and his friend are suing McDonald's for $10 million.

The man says he bit into a hamburger and had a severe allergic reaction to the cheese melted on it.

Jeromy Jackson, who is in his early 20s, says he clearly ordered two Quarter Pounders without cheese at the McDonald's restaurant in Star City before heading to Clarksburg.

His mother Trela Jackson and friend Andrew Ellifritz are parties to the lawsuit because they say they risked their lives rushing Jeromy to United Hospital Center in Clarksburg.

The lawsuit alleges Jeromy "was only moments from death" or serious injury by the time he reached the hospital.

it seems to me that if you were this allergic to cheese, you'd be a little more careful. If this guy's only precaution is to say "hold the cheese" then he's basically trusting his life to the teenager behind the counter.

I always order my McDonalds without onions. I simply don't like them...and I always check when I get my burger.

Maybe someday you should eat one with onions and then sue for bad breath and a tummy ache.;)

This guys was so aware of his condition that he claims he told them 5 times. Yet he didn't bother to lift the bun to check to see if there was cheese?

Apparently cheese is still good for catching rats.

I'm allergic to shellfish.

Rule #1 Never eat fried foods of any kind at a fastfood place that serves shrimp.

Rule #2 Even in good restaurants, ask the waiter if they use the same oil to fry your choice of food as they do shrimp or any other shellfish. If you don't get a clearcut answer, don't eat fried food of any kind.

Rule #3 Never trust a fastfood place to get your order correct.


Be cautious. Check and double check.

Cheese is plainly visible, unlike fried food tainted by shellfish.

The moron should have looked at his burger.
 
I am sure that they will get some money out of this anyway. Just like the one who got money for burning herself with hot coffee.

Hey, I wonder if I was on the road from Morgantown to Clarksburg when this was going on....Hmmmm...

If I was can I sue them too... No doubt they were rushing to get them to the Hospital, and endangered my life!!!

Hey, I may have been in your way somewhere around Fairmont. I think I'll sue you for possibly running over me trying to get out of their way.

On a serious note, if you ever get through Fairmont, eat at Muriale's Restaurant. Honestly, the best spaghetti casserole I have ever eaten. If you are alergic, have them hold the cheese!

After all the money I gave Maccas for Big Macs over the years they go and blow it like that....easy come easy go I guess....

I will... it is not very often I get over there, but I will remember this.... I love Italian!

BTW, if you are ever in my area, look me up! We have a local Micky D's, and we may be able to make some money!!! They never get my order right!!!

Ugh! Once again, someone from this state makes NEGATIVE headlines.

I promise you, not everyone in WV is as crazy as this. . .some of us are worse--like TinyTim!

I think if I were that allergic to cheese I'd have looked at the burger myself, they never come the way you order them.

Although I rarely eat at McD. now, I can honestly say I never, never , never had a quarter lb w/cheese that didn't have the cheese melted out of the sandwich and onto the paper by the time I unwrapped it.

In fact, the way I knew I didn't get cheese was because it wasn't melted out onto the paper.

Another frivilous lawsuit, IMHO
