I am getting the feeling that Ms. Miers may not make it to the November 7 start date for hearings before she steps down as a nominee.

Which would mean that Justice O'Connor may spend another year on the court with the holidays coming up and preventing a speedy process for a new nominee until early next year, and the court session ends in June, I think.

Remember this thread from a few days ago? (October 13th, to be exact)

    Why Harriet Miers will Withdraw

Now, if President Bush were as savvy as some people think he is, he would quickly nominate special prosecutor, Patrick Fitzgerald, to SCOTUS, which would then kill two birds with one stone, so to speak, by getting Prosecutor Fitzgerald off of Karl Rove's back because he'd be so busy gearing up for the Senate Confirmation Hearings about himself, LOL. :D

    It's called Judicial Hardball. [IMG]

Do you really think that the Administration will not try to force this through? Just like CAFTA, and the Energy Bill, this nomination could be done with some strong-arming by the GOP leadership.

The problem is that these issues are Democrat issues that have been around since the Garden of Eden. The main opposiition is coming from non-Christian conservative intellectuals and Catholic intellectuals.

Frankly, if she goes down, she goes down. Who cares? It has no more effect on Bush than Bork had on Reagan. The President proposes, the Senate disposes.

Frankly, I think that she is okay except that the wants women in combat but then nowadays women think that the are men anyway, or at least they act like men and smell like men.

I agree fully, but I question whether or not GWB will nominate someone I can support. I think it sad that we can't anticipate to some degree, what he'll do. At least I feel I can't. There is soooo much riding on this nominee.

Democrats are the ones that really need to be careful here.

Her replacement might be Janice Rogers Brown or Priscilla Owen, provoking the battle to institute the constitutional option which the democrats will lose .

Then Bush could ram one conservative judge after another down their throats and they would be powerless to stop it.

Bush should have done that in the first place.

I think that Pat Buchanan is turning full force against the GOP. He can never get back into the GOP as far as I am concerned. He is saying that the lady cannot talk on constitutional law and is therefore unqualified. However, she is a good lawyer and has some political experience. I think that she is okay, and I do not see that she is in trouble as long as Bush stands up for her.

The trouble with letting her back out is that Bush goes down with her in my opinion. Politically, I think that Bush has to force the Democrats and the Republican defectors to defeat her--in other words, she has to have a vote.

    CMG,

I agree. The GOP Senators should vote against her unless she can prove that she is a pro-life conservative with something more than the President's word to pacify the pro-life wing of his party.

If the Miers confirmation effort fails, then I think President Bush will go the other direction and nominate someone perceived as being more moderate than Rogers or Owen.

If he does that, he will unite the base against him and will not get anyone confirmed.

He better check his arrogance at the door.

There are enough Democrats and moderate to modererately conservative Republicans to get a moderately conservative nominee confirmed, Joseph.

And there are enough Democrats willing to obstruct the president to join forces with conservatives to oppose the president.

Exactly! That is what is at stake. She is a pro-life conservative and Evangelical Protestant but she is being opposed by Catholics Brownback and Santorum I have heard.

"I don't know yet,'' Mr. Santorum said when asked about his confirmation decision in an interview reported by the Chambersburg Public Opinion. "But I am concerned President Bush nominated someone who is a blank slate. I'm disappointed that he wanted to nominate someone like that instead of someone with a record.''

Mr. Santorum's comments came against a backdrop of growing GOP fissures over President Bush's nominee, with a line of prominent conservatives calling for the withdrawal of Ms. Mier's name in favor of a nominee with a more distinguished and discernible legal track record.

Kansas Republican Sen. Sam Brownback has said he would consider voting against the nomination of Harriet Miers to the Supreme Court even if President Bush made a personal plea for his support.

In this case, unless Miers comes out and proves that she is a pro-life conservative, I see no reason to support this nominee. If she does, the conservatives will fight the good fight for her, Catholic or otherwise. But no...I am not just gonna take Bush's word for it and end up with another O'Connor or Souter.

The National Right To Life Committee looks favorably upon Miers.

    I quote this much:

According to published reports, Harriet Miers has been active since about 1980 in the Valley View Christian Church in Dallas.

The Dallas Morning News reported on October 4, 2005, "Ron Key, who has been Miers' pastor since the early 1980s, said his church is anti-abortion."
According to material posted this week on the internet by Marvin Olasky (editor of World magazine), Nathan Hecht, a Republican member of the Texas Supreme Court, is an elder at the same church, and has been a close friend of Miers for decades. Hecht told Olasky "her personal views are consistent with that of evangelical Christians."

Means absolutely nothing. Bill Clinton was member of Immanuel Baptist Church here in Little Rock.

THIS , on the other hand, is meaningful, and would be a much stronger case for Miers. Perhaps, we should investigate this further. Maybe Miers might be ok. It still bothers me to know that she was recommended by Reid. I would really like to know why he likes her.
