My Impressions From the Roberts Hearings

    It appears to me that liberals basically want two main things from a Supreme Court justice: a willingness to keep abortion legal and a willingness to keep prayer out of government high school football games and government high school graduation ceremonies.

    That being said, I wish the Left and the Right would both move beyond abortion being the almost sole test for a judicial nominee. There are tons of other issues besides abortion.

    I continue to support the confirmation of Judge Roberts. I think he is well qualified and handled himself well before the Senate Judiciary Committee this week.

    Also, I do not want a judge to be telling publicly how he/she would rule on a case before it comes to the court. That would be like a judge or a juror telling the accused before a trial begisns that "I've already made up my mind so any arguments presented on your behalf will have no effect on my decision."

    What I want in a justice is someone who will listen to the arguments that are made and then rule based on what the law says and if the constitutionality of a law is at question to rule on its constitutionality based on what the constitution actually says, not what he/she may want it to say. I think Judge Roberts will do this.

    Ken, I hope you're right but I still fear another Souter. A few things that put me toward his corner are that Ed Meese has endorsed him along with some pro-family organizations. I wish I could remember, tho', what conservatives endorsed Souter before his confirmation.

    I absolutely agree with you: I also want a justice who will listen to the arguments and rule based on what the law says.

    After observing Judge Roberts during the confirmation hearings, I have great admiration for him. I have no doubt that he will rule according to what the constitution says. While I may not always agree with him, I trust him to do the job.

    In choosing the next justice, I hope that both liberals and conservatives will move beyond abortion. There are other issues of equal importance.

    Here is a LINK to recent Supreme Court nominee hearings. I tried to open the Souter hearings but it is taking forever, due to its size (1210 pages, pdf) apparently.

    The main question to be asked and answered should be whether or not the nominee is able and would likely hear the facts brought before them and rule on them according to the Constitution and not his on views of how it should or should not be. The nominee should be chosen to fill the role of supreme court justice and not a legislator motivated by political goals or responsiveness to popular opinions.
