    Running Surpluses is Stealing
    Although taxation is legitimate, running a government surplus isn't. It represents a taking by the state, because it exceeds the government's contract with the community. It is no different than if a federal agency were to take a person's land or possessions without just compensation (an activity barred by the Fifth Amendment). Excess taxation isn't what the people bargained for.
    In presuming entitlement or authority not ceded by the community, the state abrogates its moral pact with those it governs. Its power is no longer derived from the people, whose rights to liberty and property it boldly denies.

    Of course, this report of 3 years old. Are we sure NJ has the same surplus now?

    I agree. We are constantly batteling our state Govt. (Oregon) over whose money the excess is. they want to establish a rainy day fund with it.

    Seems like the Governor shutting down the State government because of lack of funds would constitute a rainy day.

    I don't know who to blame, the Legislature or the Governor, but I suspect that neither one of them are blameless.

    Our point is that the money is not theirs in the first place and should be returned to taxpayers. The governor so far refused to include language pertaining to what constitutes a rainy day. I wouldn't want it to include financing his notion of bringing auto emmissions up to california standards, for example.
    but the point is that it is excess and should be returned to taxpayers.

    The budget deficit is not the same thing as 'we don't have any money'. That is just the deceptive financial reporting practice that the governments employ to justify the continual excessive taxing of the population.
