Court ruling says city can't take property

Ohio eminent domain case veers from federal decision
By Gregory Korte and Steve Kemme The Cincinnati Enquirer

NORWOOD, Ohio — The city of Norwood cannot take property by eminent domain to give to a private developer, the Ohio Supreme Court ruled Wednesday.

In holding parts of Ohio's eminent domain law unconstitutional, the state's highest court set a different course than the U.S. Supreme Court did in its Kelo v. New London decision last year.

There, the Supreme Court ruled that a Connecticut city's taking of property for economic development was constitutional — but made clear that state constitutions could set different standards.

The Norwood case is the first major eminent domain case to reach a state supreme court since Kelo.

    Excellent.

Not to go off topic, but has anyone heard how the effort to condemn Justice Souter's property went/is going?

No, but it should be bull dozed to make the point that the leadership of this country used to pledge their property and their lives for the good of the country.

I wonder if liberals find it strange that they are in support of the same "evil" corporate developers that they demonize so often.

    Logical Fallacy Alert!

Broad Brush, as if all "liberals" are a monolithic force without any diverse opinions on specific issues.

And yes, Daisy & Galatian, I too find the obsessions of some to be a source of amazement and amusement.

    Liberals are up in arms!

They like being liberals but don't want to be called one or associated with this decision that was handed down by the liberal block of SCOTUS.

Obsessed, and showing ignorance, as I was quoted and it was implied that I am against this ruling. Truly, I am all for eminent domain in cases for public infrastructure, but totally against it for giving private land to private developers. Blind partisanship makes a person invent strawman positions not even espoused. Sad.

Obviously a severe case of Coulter's syndrome.

Coulter's Syndrome n. A compulsive need to attribute evil/stupidity/error to anyone disagreeing with one's self, often accompanied by fantasizing spurious opinions to such others.

    Typical liberal response.

Can't handle the subject so resort to personal attacks.

This is really an easy subject.

If you are in favor of government confiscation of private property in order to enrich corporate interests, just stand up and say so.

If you agree with the SCOTUS decision, say so.

Take a stand and quit crying about someone calling you a "liberal" when there's a debateable issue on the table.

I had no idea you were a liberal, carpro.

I believe all here have said that it's a bad decision. At least I did. Your illusions about who is a liberal and what liberals must believe led you to make some faulty assumptions. And you know what assume does...

Being a libertarian, I oppose the decision, as you likely noticed when it came up here the first time. Because you and I often disagree, Coulter's Syndrome caused you to assume that I was a liberal and I agreed with the decision. You then made some personal attacks on various people you identified as "liberal." (while simultaneously asserting that is what liberals do).

    Think next time.

Keep it up! You are winning them over! Any time now they will move from something not so good to something not as bad . . . ;)

Just don't let 'em migrate down here! ;)

Sometimes, I cannot resist the satire. I really should resist, but as has been duly noted - I am a sinner. OK, I give how does one tell them apart? Which one has the bigger yellow stripe?

Now before anyone gets allllll riled up, I did NOT say they both had yellow - just that one had a bigger yellow stripe. Since I don't know either group well, I figured I would at least give one of them the benefit of the doubt.

(Barbarian points out that he's opposed using emminent domain for private projects)

Yep. Back when the decision was made, I pointed out that a mall in Arlington Tx, had done this, and I pointed out that it was wrong. On this board.

Actually, on your obsession. Coulter's syndrome.

Coulter's Syndrome n. A compulsive need to attribute evil/stupidity/error to anyone disagreeing with one's self, often accompanied by fantasizing spurious opinions to such others.

As you see, your obsession led you to forget what I had written earlier, and to invent a spurious opinion for me.
