    West Palm Beach, Florida - Rush Limbaugh was arrested Friday on prescription drug charges, law enforcement officials said.

    Settlement Agreement Ends State Investigation of Rush Limbaugh
    Fri Apr 28 2006 18:59:55 ET

    Palm Beach, FL – April 28, 2006 – In response to media and other inquiries, Roy Black, Rush Limbaugh’s attorney, released the following statement today concerning a settlement agreement with the Palm Beach County State Attorney’s Office to end the investigation of Mr. Limbaugh:

    "I am pleased to announce that the State Attorney’s Office and Mr. Limbaugh have reached an agreement whereby a single count charge of doctor shopping filed today by the State Attorney will be dismissed in 18 months. As a primary condition of the dismissal, Mr. Limbaugh must continue to seek treatment from the doctor he has seen for the past two and one half years. This is the same doctor under whose care Mr. Limbaugh has remained free of his addiction without relapse.

    “Mr. Limbaugh and I have maintained from the start that there was no doctor shopping, and we continue to hold this position. Accordingly, we filed today with the Court a plea of ‘Not Guilty’ to the charge filed by the State.

    “As part of this agreement, Mr. Limbaugh also has agreed to make a $30,000 payment to the State of Florida to defray the public cost of the investigation. The agreement also provides that he must refrain from violating the law during this 18 months, must pay $30 per month for the cost of “supervision” and comply with other similar provisions of the agreement.

    “Mr. Limbaugh had intended to remain in treatment. Thus, we believe the outcome for him personally will be much as if he had fought the charge and won.”

    The actions taken today are as follows:

    The State Attorney has filed a single charge of doctor shopping with the Court. The charge is being held in abeyance under the terms of an agreement between the State and Mr. Limbaugh.

    Mr. Limbaugh has filed a plea of “Not Guilty” with the Court.

    The formal agreement between Mr. Limbaugh and the State Attorney will be filed with the Court on Monday. The terms of the agreement are substantively as follows:

    Ø Mr. Limbaugh will continue in treatment with the doctor he has seen for the past two and one half years.

    Ø After Mr. Limbaugh completes an additional 18 months of treatment, the State Attorney has agreed to drop the charge.

    Ø Mr. Limbaugh has agreed to make a $30,000 payment to the State of Florida to defray the public cost of the investigation.

    Doctor shopping is when a person/patient goes to more than one physician, without telling the other physicians, to get more than one prescription for a desired drug...

    If the patient has a *real* medical condition it is easy to get a prescription...

    Federal law limits pain meds and many people with chronic pain do this type of thing to get enough pain meds to function.

    This is because federal Law does not allow one physician to prescribe enough meds for some types of chronic pain...

    At least not without the doctors license being put in jeopardy...

    There have been some recent changes for the better...

    In the case of some people though...

    The need to see more than one doctor to get enough meds to function starts an addictive behavior.

    Which if only one doctor could do the required prescribing, they would see the behavior start and nip it in the bud...

    There are also doctors that will prescribe whether you need the meds or not...

    And, plain ole addicts doctor shop until they find one or more of those types of doctors to get their meds...

    At least that's how it was explained to me. :D

    Limbaugh is emphatic that he was not doctor shopping. Either someone's forged a lot of false prescriptions to frame him, or he's still in denial.

    I wonder if I ever get into trouble with the authorities over some type of drug charges, will I be given an opportunity to "work out a deal" with the District Attorney? Or, would I be handcuffed, taken to jail, charged with a crime, and then be put into a cell?

    Hey, Terry, a person who is well-connected, or is wealthy, or is a government official gets better treatment from the court system. That's the way it always has been and always will be as long as this earth lasts.

    Of course, since this was a non-violent crime I wouldn't want to see Rush being put in jail anyway. Prison should be reserved for violent criminals. Non-violent criminals should pay fines/do community service.

    If you have money and a really good lawyer, the result will likely be similar to Limbaugh's.

    I believe the DA was running scared, afraid that his only evidence, dubiously acquired private medical records, might be ruled inadmissable

    This is still from the first investigation from '03.
    This is the First and Only arrest that has been made.

    You would be charged, given an opportunity to turn yourself in.

    If you did, then, most likely, you would be put in a holding area (not necessarily a "cell") while certain administrative duties are fulfilled, just as Limbaugh was.

    Then, at your arraignment, your lawyer would advise you to plead guilty, at which time you most likely would be sentenced to treatment and given probation.

    I was the manager of a pharmacy (Eckerd Drug) for a couple of years and was involved in seven or eight of these cases. It's really much more common than you think.

    Courts are always much more lenient if you can demonstrate that you did it because of an addiction. If they find out that you did it for profit, they will bury you under the jail and, in many cases, that can be a federal offense.

    I wonder if Terry were to get in some kind of trouble concerning drug charges if the DA would go on a 2 1/2 year crusade of breaking the law by looking at his confidential medical records without a warrant just to try and smear him. Probably not. But hey, he obviously isn't as lucky as Rush Limbaugh the celebrity. :rolleyes:
