21st “American View” Talk Show Asks: Why Has Jay Sekulow Used Pro-Life Issue To Raise Millions Of $$$ But Now Says: No Abortion Questions For John Roberts?

Our 21st nationally-syndicated, one-hour radio show, “The American View,” co-hosted by myself and recovering Republican” John Lofton, was broadcast this past Sunday in 38 cities in 22 states.

    mp3Hear it now (10,618 kb)

On this program, we discuss Jay Sekulow’s strange view that Bush Supreme Court nominee John Roberts, in his confirmation hearing (which starts September 6), must not be asked about, and must not answer questions about, abortion or any abortion-related court decisions such as Roe v. Wade. We say this is strange because Sekulow and his organization, the “American Center For Law & Justice,” have raised millions of dollars pushing the pro-life issue! We interview a Bush-worshipping cheerleader for John Roberts (it does not go well once he sees we are not also cheering for Roberts). And we discuss God and Hurricane Katrina.

Roberts is a big question-mark on the abortion issue. I personally think he was picked precisely because of his lack of a solid paper trail for or against abortion. Bush is trying to slide him through the process, and, perhaps, he knows that Roberts is pro-life from personal and behind-the-scenes interviews......perhaps. His wife has led the Feminists for Life group, but that is his wife. He is conservative on most issues. Is he a Thomas or Scalia or Rehnquist? I don't think so. BTW, if Bush messes up and does not replace both Rehnquist and O'Connor with solid pro-life people, I'm personally going to desert the Republican Party. If Bush messes up on this one, I'll know the GOP is a scam, saying anything for the massive vote of the religious right, and never delivering results. The court could be 7-2 pro-life right now, if all the present justices appointed by Republicans were actually pro-life. That's simply unacceptable. As it is, even if Roberts and the Rehnquist replacement are pro-life, the court still stands 5-4 pro-choice.

I just hope that President Bush has learned from the at best lukewarm response to Roberts from conservatives to nominate a solid conservative (again, my pick is Michael W. McConnell) with a solid record to fill the CJ's seat on the high court.

    Bluefalcon,

I'm sorry but I gotta ask 'cause I've been dying of curiosity, what is with the Red Chinese flag avatar?

Given the news of Chief Justice Rehnquist's death, my choice -- now more than ever -- is Roy S. Moore:

    http://www.conservativeusa.org/roymoorepetition.htm

    ROY MOORE FOR SUPREME COURT
    Petition to George W. Bush
President of the United States of America

    Whereas,
some Supreme Court Justices are consistently unfaithful to the plain text of the U.S. Constitution, and

    Whereas,
the Supreme Court needs more Justices with the perspective of Anontin Scalia and Clarence Thomas and fewer pro-abortion, pro-homosexual Justices such as David Souter and Ruth Bader Ginsburg,

    THEREFORE,
I hereby petition President Bush to nominate to the Supreme Court Judge Roy Moore, who has already demonstrated his understanding of and fidelity to the U.S. Constitution...

Roberts should answer no question on issues that might come before the Court.

Bush nominates Roberts as chief justice

President Bush on Monday nominated Judge John Roberts to succeed the late William H. Rehnquist as chief justice of the United States.

"It is fitting that a great chief justice be followed in office by a person who shared his deep reverence for the Constitution, his profound respect for the Supreme Court and his complete devotion to the cause of justice," Bush said from the White House, with the judge by his side.

"I am honored and humbled by the confidence that the president had shown in me," Roberts said.

I don't understand how someone with only two years experience as a judge is a candidate for chief justice.

A lukewarm response from conservatives may be a good trade for not having an all out war from the left.

I don't understand how someone with only two years experience as a judge is a candidate for chief justice.

If you look back through the history of Supreme Court Justices many had little or no experience as judges. Rehnquist, when nominated by Nixon, had no experience as a judge. He had however, been the US Attorney General.

I agree with OldRegular. Roberts should not answer questions about any issues that may come before the court. It is unethical.

Also, it is hard to guage how a person will respond after being confirmed as a Justice. take Earl Warren, for example. Before being confirmed, he was a staunch Republican. In fact he was a local DA in CA, and he argued against rights of the accused. Low and behold as a Chief Justice he was one of the most activist judges. He was a real champion of civil rights and "due process of law".

Ginsburg refused to answer questions about court issues at her hearings and she should resign. So Roberts should not answer questions about court issues either.

Daisy, NARAL did go all out. And about 30 Democrats are expected to vote against Roberts for no good reason. The Democrats have to stop abortion. They are no longer a majority party but they are the major force in support of abortion in their political party platform.

Do you think the announcement today that Roberts is now the appointee for Chief Justice will have an impact?

If I have to speculate, I would say that Roberts was the President's pick for CJ to begin with. All of the speculation flying around in July was that Rehnquist would resign, so Bush had picked Roberts as the replacement. When Rehnquist stated he would not resign, and then O'Connor did, Bush panicked a bit, thinking that he might miss his opportunity if Rehnquist did not resign during his presidency to appoint John Roberts, so he settled for Roberts as an associate, for the time being. If and when Rehnquist would later die or resign, he would then elevate John Roberts to the top post.

I believe he will now nominate Janice Rogers Brown to fill the O'Connor vacancy. I think those were his two choices for these two spots to begin with.

I just hope that Roberts truly is in the mold of Rehnquist.

    Daisy,

A lukewarm response from conservatives may be a good trade for not having an all out war from the left.

Excellent point, that I've already worried about. The problem is that the nominee who produces the lukewarm response may turn out to warm liberals' hearts a la Souter.

    Bro. James,

I just hope that Roberts truly is in the mold of Rehnquist.

I hope that he's in the mold of Scalia but would certainly settle for a Rehnquist.

I would like to see Bush nominate Judge Brown. All the liberal left, pro-abortion activists would die and rollover in their coffins. However, I think he will pick another woman, perhaps Judge Jones. There are a number of Strict Constructionists from which Bush can choose.

I actually believe that Rhenquist knew that he was dying and passed that on to Bush.
