Serial Killer Hunt

Are they letting the cops swab them willingly? I don't remember the article saying, but doing that without a warrant would be a 4th Amendment violation.

 

Even if they are giving this information away willingly, it is still a vioaltion of their right to privacy. The article says the police are already not using the DNA in their hunt for a serial killer, but also in a prostitution sting. Really, once that DNA is in the police's hands, they can use it for anything they want.

You have to have a warrant for that, I think a lot of people don't know that apparently.

Nothing. The police can ask you anything they want.

I wonder though, if a person refused to give up their DNA, would that then be enough probable cause for the police to get a warrant?

A lot of crimes are solved simply because people don't know and/or invoke their Miranda or 4th amendment rights.

 

Personally I would go along with it. I have no fear of past, present or future crimes. But it doesn't seem right.

They can yell at me and rassle me to the ground, and they can tase me, but they will have to pry my mouth open with all their strength.

 

Thats right. People faught and died for that right, it's mine becasue I am an american citizen, and I am not handing it over.
