    "The conservative critique of Miers rests primarily on two legs. One is based on a singular, a-historic vision of Supreme Court appointments. We didn’t use to require appointees to the Court to be judges, academicians, or legal scholars. Louis Brandeis, Robert Jackson, Earl Warren, Byron White, William Rehnquist, Lewis Powell – none of them came to the Court with those qualifications. Each of these justices left a mark on the law. Although the current Court has three justices who were established scholars before taking seats on the bench, appointment of scholars to the Court has been the exception, not the rule. It is fair to want nominees who have the breadth of knowledge, interest in constitutional issues, and writing skills that scholarly publication can convey. But scholarship has never been the sine qua non of appointment.

    The other major line of attack on Miers comes from conservatives who are demanding proof that Miers shares their beliefs. But conservatives repeatedly have asserted that judges shouldn’t make commitments in advance to particular positions. We can ask that they commit to a vision of judging, a way of interpreting the law, an understanding of constitutional interpretation. We shouldn’t ask their positions on particular matters that are likely to come before the Court. That was our answer to liberals like Chuck Schumer who want judicial confirmation hearings to focus on ideology. It should be our answer to ourselves."

    Ken,

    So: (1) she's a lawyer, (2) she goes to a conservative church, (3) she helped President Bush pick his other nominees. Therefore, she should be on the Supreme Court?

    This statement is disingenuous in characterizing the conservative opposition to Miers. It's not that she won't tell us where she stands now, it's that there was no evidence from prior to her nomination that she will be a good Justice by conservative standards.

    At this point we will all just have to wait and hear Ms. Miers during her hearings before the Senate judiciary committee. If she does poorly, then I will switch to opposing her confirmation. If she does well, then I hope those conservatives who are currently opposing her will switch to supporting her confirmation.

    As I've said before, my problem is not with her, but with the President for not nominating one of maybe 50 fully qualified and well known people we can support.

    I support her now but why nominate number 51?

    and people who have already been confirmed by congress.

    I think she'll get through, but I am skeptical of this nominee. For the most part, I like Bush, but I haven't been happy with all of his decisions.

    Ken, the fact that you can point this out and the media has not, shows how biased the media is. If Miers appointment is not unprecedented it would seem newsworthy to say it.

    Supposing we listen again to Pat Buchanan, who has betrayed the GOP and ran for President twice on a 3rd-party ticket. What then?

    The fact of the matter is that the conservatives cannot deliver the votes that they say that they can. When they tally their bloc, they take Evangelicals for granted as being with them.

    Well, I for one am not with Buchanan and the others on this issue. Bush is weak and cannot win a fight because of McCain and Graham and all of the rest of the gang of 14 that would not allow the so-called nuclear option to be put into place and majority rule to be installed in the US Senate. Where was Buchanan and the others then? Hiding. Buchanan is really saying let's you and them fight. Well, I am not taking marching orders from some 3rd-party guy.
