I know it doesn't go without controversy.
Over a billion ( maybe even nearly 2 billion) of so-called Christians are misguided that they are born again by Water Baptism, and that the water in John 3:5 means the physical water, as they are misguided with the Transubstantiation in John 6.
1. We must understand Blood and Water is the typical expression by the Holy Spirit thru His servant John, and we read this in 1 John 5:8. In verse 7 he mentioned the Trinity of Father, Word, Holy Spirit, then goes on to explain Spirit, Water, Blood in verse 8, and this can mean the water baptism no way, but the the cleansing power of the Word of God leading to the repentance.
2. If anyone interpret the Water as the Water baptism, the Robber at the Cross who died after the conversation of John 3:5 couldn't go to the Paradise, without having the Baptism. The Spiritual Baptism which means the Being Born again is always available at any time as long as the person repents and accepts what Jesus has done, by Holy Spirit.
3. Many people who misunderstand the Water meaning water baptism do not have the actual experience of Being Born Again, then they often misunderstand the Salvation.
Jesus didn't approve the believers who believed in Him, but still said that they should abide in Him and His word should abide in them. Was it because they were not baptized yet? The actual salvation means the spiritual change. We know Cornellius received the Holy Spirit before they were baptized, and the person who has the Holy Spirit in his or in her mind will go to the heaven because of the Spirit of God who raised Jesus from the dead.
As I mentioned, there were plenty of the problems with the fake Christians even during the Early Church of NT.

Sorry, if my statement was too much exclusive, as I can hardly express many points and aspects within a short sentence. But if the person doesn't have the actual, personal relationship with God, then his or her whole view about so many things in the life is different from that of the Born Again believers, and therefore it is correct that we do not take the Unbelievers history as the final authority, though we may refer to them to refute their own arguments.
