Who would support a homosexual justice?

I voted number two, but with some reservation. If a homosexual were a strict consturctionist I am not sure how I would feel.

I voted #2 because of the word "open."

 

Eventhough I think Harriet Ellan Miers is a very
public figure and it is making the rounds on the
blogs and in the news her support of the Dallas
Gay Community...I think the first poll was really
valid and I really insured it with <If> and parsed with a question mark. I really do not think we have heard the last of it and she may very well be the first gay woman supreme court justice. imho

Now this poll is using basically wording that is
from the right and not from a middle point.

With that being said lets see what this poll has
to offer keeping in mind that this supreme court
pick is friendly to the gay cause. again imho

President Bush on Monday nominated Dallas native Harriet Ellan Miers to the United States Supreme Court — turning the eyes of the nation on a 16-year-old document stored in the garage of longtime lesbian leader Louise Young.
Bush named Miers, the White House counsel, to replace retiring Justice Sandra Day O’Connor. Miers, formerly a prominent Dallas lawyer and a past president of the State Bar of Tex-as, is a longtime, close associate of Bush’s. She has no prior experience as a judge.
When she heard the news of Bush’s nomination, Young re-membered that Miers had appeared before the Lesbian/Gay Political Coalition’s screening committee when Miers ran for the Dallas City Council in 1989. The politician did not ask for the political coalition’s endorsement, but she filled out the questionnaire and spoke to the group.
Rummaging through the storage boxes that she had moved from Dallas to Vermont and back, Young found the document. Its existence has now been reported by virtually every news organization in the country.

 

There's no reason for thinking that she is gay or actively pro-gay. Read the story you posted on the other thread.

So far all I see is that she's polite and that she supports action to prevent the spread of a terminal disease.

 

I think a nominee should keep his/her sexuality out of the public limelight.

I don't know if this is the case here but I find it irksome when people tend to assume that because someone has never married that he/she is a homosexual. I was 38 years old before I was married and almost that old before I ever seriously dated a girl. And I am as heterosexual as can be.

 

If it were not for the homos desperate need of the public's acknowledgement/approval/blessing or whatever, a person's sexuality would be a non-issue!

 

There has been no proof offered that Miers is a homosexual and certainly nothing she has said about her sexuality in public - period.

I find it strange that this topic has even come up at this time.

I believe that if the conservatives fail to get behind Miers and end up causing her confirmation to fail that they will have only themselves to blame when Bush then nominates someone less conservative than Miers, maybe someone even basically like O'Connor. I don't think that Bush will reward the conservatives' rebellion to Miers.

 

Are you telling me that Miers isn't? How do you come to that conclusion? Instead of fighting the war for the court and nominating somone like Brown or McConnel, Bush chose a consensus candidate who is backed by Harry Reid.

Miers has stated "It is the responsibility of every generation to be true to the founders' vision of the proper role of the courts in our society. If confirmed, I recognize that I will have a tremendous responsibility to keep our judicial system strong, and to help ensure that the courts meet their obligations to strictly apply the laws and the Constitution."

 

The conservatives are against Miers. They wanted a big Senate fight, which would have been lost because of the Eastern Republicans.

Miers is being called a party hack. Charles Krauthammer says this about her:

"By choosing a nominee suggested by Senate Democratic leader Harry Reid and well known only to George Bush, the president has ducked a fight on the most important domestic question dividing liberals from conservatives: the principles by which one should read and interpret the Constitution. For a man whose presidency is marked by a courageous willingness to think and do big things, this nomination is a sorry retreat into smallness."

I know it is not the case on this board but I honestly believe that the opposition to Miers by people like Bill Kristol and David Frum is not about whether or not she has conservative judicial views but instead has a large dose of elite snobbery in it because Miers graduated from SMU and not an Ivy League school in the northeast.

 

I believe that the SC is one of the big reasons many heartland conservatives voted for Bush last year, and I think many of us would have helped him fight this war. But now, he is asking us to help him fight a war for a lady we don't really want. I did not elect him to nominate a consensus justice like O'Connor. Whenever I recieve my e-mails from Ken Mehlman asking me to help the GOP fight the battle to get Miers confirmed, I have to snicker at the thought. The truth is that the DEMS will put on a show that they are concerned about her and then confirm her because they know that she is no threat to their power in the court.

There is no reason to believe she is not a conservative, pro-life justice, Joseph. Who do you think has been helping the president with the nominations of the other conservative, pro-life justices to the appeal courts and with the nomination of Roberts to the SCOTUS?

 

I know who helped with this nomination: Senator Harry Reid.
