Featured Police charges in Freddie Gray case are incompetent at best

    Author Page Croyder spent 21 years in the Baltimore state's attorneys office, most recently as a deputy state's attorney.

    Baltimore State's Attorney Marilyn Mosby's "quick" and "decisive" action in charging six Baltimore police officers a mere two weeks after the death of Freddie Gray reflects either incompetence or an unethical recklessness.

    Alan Dershowitz, the noted defense attorney, sharply criticized her for using her charging power as "crowd control." John Banzahf, a George Washington University law professor, predicted the eventual dismissal of most if not all the charges. The breadth of the charges, Ms. Mosby's overreaching, is all-too-obvious.

    Any prosecutor interested in the truth and in justice would have used all the tools at her disposal to find them. Ms. Mosby ignored them. She has one of the most experienced homicide prosecutors in the state of Maryland as chief of her homicide unit, but did not ask him to investigate. She had the police report all of one day before filing charges, her mind already made up. And she failed to make use of the grand jury to gather, probe and test the evidence before a group of average citizens.

    In fact, Ms. Mosby was so hasty it appears she locked up two completely innocent officers. She charged Freddie Gray’s arresting officers with “false imprisonment” because she said the knife that Gray had on him was legal. In fact, as The Sun reported, the Police Task Force found it to be illegal after all. It was Ms. Mosby who had no probable cause to lock the arresting officers up, an injustice she could have easily avoided by taking her time.

    The Fraternal Office of Police called Ms. Mosby's charges an "egregious rush to judgment." It smacks more of a calculated push to the spotlight, filing charges after a mere two weeks. She conducted her own "parallel" investigation using her police integrity unit (the only unit listed on her published staffing tree missing the name of a supervisor.) She had no time to evaluate the crucial autopsy report, or consult with experts about its implications. In her haste to step into the national limelight, she circumvented normal charging procedures by grabbing a member of the sheriff's office to swear to their truth and file them for her. She calculated her actions for surprise and maximum effect, and she got it.

    Yes, and their incompetency lead to their being guilty of murder.

    Incompetence leads to serious mistakes ... in all areas of life.

    What evidence is there that justifies he death? None at all.

    Gray was alive and had no spinal injury when the police stopped him. He had a fatal injury by the time he arrived at the station. They did not follow procedures correctly, did not strap him in and he died.

    Serious mistakes on the part of the police.

    He had, as far as we know, committed no crime that day. No good reason other than incompetence that he is dead.

    I believe Bro C is correct and the charge will be involuntary manslaughter.

    Gray fled the police for no good reason except that he had a switchblade. He was well-known to the police for his long record. He might have been involved in the Heroin traffic. A witness said that he was throwing himself around in the wagon. Gray had just been released from the hospital for spinal surgery. I think that he was a suicide.

    As Dershowitz points out, the public does not like overcharging and tends to acquit when it is clear that the government has trumped up the charges. In nazi Germany trumped up political charges might have been the order of the day to placate the nazi mob or in ancient Rome trumped up charges might have been used to placate the plebian mob but in a republic built upon liberty such tactics are hated by the people.

    Still involuntary manslaughter as he was supposed to be strapped into the seat and the police are not supposed to give a person a rough ride. As Rev said they are guilty of incompetence and that lead to involuntary manslaughter.

    The knife is an aside and has nothing to do with their guilt or innocence.

    And the other fellow clarified what he said, saying the Washington Post and other papers misrepresented what he said about what Gray was doing.

    The witness realized that he would become a target on the street so he tried to backpedal. It has not been proven that the driver gave anyone a rough ride but then Baltimore streets are probably very bad as Baltimore is a center for heroin and a center for political corruption.

    Because of the overcharge, there will probably be a change of venue and another prosecutor. The current prosecutor has clear conflict of interest and looks very corrupt on the surface. The charges were aimed to quiet the riots and are un-American. All they have done is to postpone the riots until when the truth is decided.

    Forgetting to fasten a seatbelt is not manslaughter.

    The blatant overcharge will probably lead to full acquittal. Remember the responsible authorities here were all Democrats.

    I believe the thread and OP is about the incompetence of the state attorney, not the police officers.

    What you are saying is irrelevant and conjecture is mostly the observation of liberal Democrat Harvard Law Professor Alan Dershowitz. To paraphrase Dershowitz, this is not ancient Rome where the law was political and bloody, this is a free republic with a Bill of Rights and the overcharge will likely lead to a change of venue, a new prosecutor, and an acquittal because the American people do not like prosecutorial overcharge for political reasons.

    And Baltimore is considered by police to be the H capital of the USA.

    Apparently you are not aware but the charges have already been issued and the are far beyond that already at this point. If you are going to speak to an issue be informed first. Second, even liberal law experts are saying to charge the officers with anything at this point is both premature and likely a result of an agenda. This prosecutor has discredited herself by issuing these charges. I suggest you read up on what is going on and come back and speak intelligently.

    The police were patrolling and he ran away. They stopped him--perhaps they recognized him--Baltimore is a pit and the H capital of the USA. When they searched him, they found a switchblade that was illegal in Baltimore.

    The prosecutor is declining to release information about the knife, probably because the police report that it was a switchblade and illegal in Baltimore is correct.

    When Prosecutors overcharge, especially for political reasons, it tends to anger and confuse juries and makes juries think that the prosecutor is a novice--that's a paraphrase of what liberal Democrat Harvard Law Professor Alan Dershowitz says.

    It is the Democrats who think that this deal in Baltimore by the Prosecutor is un-American.

    The AG filed murder charges because 1. It quelled the riots. 2. It benefited her optics. That's it. She knows the most serious charges won't stick. I want to know what her plan is when riots erupt after the officers are acquitted.

    Baltimore apparently has city laws about knives. The prosecutor is declining to release photos and descriptions, suggesting a cover-up. She is best friends with the victim's lawyer and her husband is an elected city council member. Talk about a conflict of interest.

    The main problem in Baltimore seems to be H.
