    If I was a judge and faced with this decision, I would have to consider if the woman had the means to pay for her treatment. Obviously if she is shoplifting what appears likely to be food, she does not have the money to pay for her treatment. So who pays? Medicare will pay some of it if she has Medicare. Medicaid the State pays but depending on the state they may require her to use up her assets first. Incarcerated the State pays.

    There is mention of drug use and mental health issues. If these issues are serious concerns, it is possible they may put her recovery from the surgery at risk. If so, being in jail may benefit her medically.

    I would want to know more information than what is included in this article before I could make that call myself. So, I will not judge the judge, at least not yet.
