Acosta victory undermines media's Trump narrative

The mainstream media are celebrating Friday’s decision by a federal judge to force the White House to restore CNN correspondent Jim Acosta’s “hard pass.”

Judge Timothy J. Kelly’s decision is being treated as a victory for the free press, and proof that the Trump administration’s decision was wrong and violated Acosta’s constitutional rights. But the decision undermined the picture of the Trump administration the media have sought to portray, in three ways:

The first way

1. A Trump appointee ruled against Trump. The media, and their Democratic Party allies, have treated President Donald Trump’s judicial nominees as if they can be expected to be slavishly loyal to the administration. That is why, for example, they focused on Brett Kavanaugh’s views on whether a president can be indicted while in office. The left expects judges to vote their “party,” because that is what left-wing judges do. Kelly, a Trump appointee, did not.

The second way:

2. Conservatism helped the media. Judge Kelly specifically said: “I must apply precedent as I see it,” even if he did not agree with it. Acosta won — thanks to the conservative judicial philosophy the president has prioritized in his appointees.

I expect the never Trumpers here to be pretty quiet on the subject. The narrative has certainly proved to be just that, all talk with no substance.

President Trump put liberal hack reporters on Friday on notice.

"...President Trump told Fox News’ Chris Wallace that he will kick CNN White House reporter Jim Acosta out of press conferences if he “misbehaves” going forward after a federal judge temporarily restored his press pass.

Trump sat down with the “Fox News Sunday” host on Friday for a wide-ranging discussion – the first time Wallace has interviewed Trump since he took office. Wallace pointed out that a federal judge ruled earlier Friday that the White House must reinstate Acosta’s press credential.

“Yeah, its fine, I mean it’s not a big deal. What they said, though, is that we have to create rules and regulations for conduct etc. etc. We’re doing that, were going to write them up right now. It’s not a big deal and if he misbehaves, we’ll throw him out or we’ll stop the news conference,” Trump said....."

3. The president accepted the decision. President Trump accepted the validity of the decision. He also ordered the White House to develop new rules for press behavior, in conformity with the ruling that Acosta’s due process rights had been violated. Compared with Obama, who often tried to ignore court decisions he lost, Trump’s approach was refreshing — and the opposite of the “autocrat” image the media have contrived.

The only decision that the judge made was to issue a temporary restraining order. Trump is obeying the order to the letter. The judge said the reason for the order was denial of due process. The White House is putting together a list of rules for behavior.

Doing everything the judge wanted right down the line. When the 14 days are up, they intend to enforce their rules.

If it goes back to the same judge, they will lose again. He's not about to reverse his own order. But if it goes to the appeal process, I believe Acosta and CNN lose on the merits, because Judge Kelly is misinterpreting precedent.

The fact is they don't have to hold press conferences and they don't have to allow questions. At all. And above all, the president doesn't have to allow anyone into his home that he doesn't want there. And the White House is his home.

IF a Fox reporter treated president Obama exactly same way Acosta did trump, there would be NO doubt that he would have been banned for life from WH, and there would have been no CNN taking his case to a Judge!
