I don't think I would go that far. There is certainly a legal mandate for divorce (Deu 24) a writing of divorce. So if the divorce required some legal means I think all marriages do also even if they vary. While the way to express legal marriage has changed I don't think that marriage is intended to be without legality.

We regulate septic tanks and sewer systems but not eating.
