Calif. Senate Passes Gay Marriage Bill

The California Senate voted Thursday to allow gay couples to wed, becoming the first legislative body in the nation to approve same-sex marriage without a court order.

The bill would recast the state's legal definition of marriage as a union between two people rather than one between a man and a woman.

If the bill makes it to the governor's desk, let's hope that he will have the intestinal fortitude to veto it. I really doubt that he will though.

I am not sure about the specifics in California, but what happens in most states and the federal government is that the bill doesn't become law without executive signature. If there is no signature, the legislature can override this veto with a supermajority vote, usually 2/3. Of course all states except Nebraska have a bicameral legislature, so Senate AND House of Representatives approval is required before a bill ever reaches the desk of the governor.
