My lovely bride works for an Orlando-area company that has mandated that all their employees are to be vaccinated within 60 days or lose their jobs. We know that Pfizer-BioNTech, Moderna, and Johnson and Johnson have been indemnified against liability by the U.S. government. The gray area comes into play when companies mandate that their employees be vaccinated or lose their jobs. If an employee is vaccinated and has serious complications (anywhere from required hospitalization to death), is the employer liable for damages?
Before you are quick to say no, consider that attorney's are already prepping to file cases against some big employers like Apple, Walmart, and Disney. All of these companies have mandated the vaccine for their employees. Also, some of these companies are no offering any exemptions. Disney is offering an exemption only to off-site employees, but those employees must show proof of vaccination before they can enter any Disney building. Employees who are allergic or who have had a past negative reaction to a vaccine constituent are not being offered exemptions by some of these companies. That means they will be unemployed. The lawyers are getting ready to go to court over that issue as well.
