How, ACCORDING TO THE CONSTITUTION, could he have stopped it? Please show me the mechanism in the Constitution. Not some half-rate lawyer's opinion.
The COTUS says what the SCOTUS says it says. He could have forced a ruling.
Constitution guarantee gay marriage? Guarantee a right to kill a baby. Heck no! BUT Dems forced it and got SCOTUS to say it did. It's a nasty game. People like you and Pence are why we keep losing it.

So because Pence didn't play against the rules he is a scumbag?

Yes He could have. No one could have stopped him. He could have sent election to SCOTUS.
And the Constitution doesn't say he had the right to do that either. It says Pence open them. Count them. To do so would be to violate his oath. Apparently, that doesn't matter to you.

To all concerned -
Why are you still crying about the 2020 election - it is over

Rather, you should be concerning yourself about the 2022 congressional elections
and getting more conservatives elected.
and I don't mean just complaing here on BB or other media.

GET INVOLVED WITH YOUR POLITICAL PARTY
FIND OUT HOW TO GET ON THE TOWN, COUNTY, STATE COMMITTEES.
BE PART OF THE SOLUTION - NOT PART OF THE PROBLEM.

Here is NY we have a double situation.
First our Congressman is a RINO - thus our party has stated we will not endorse him. So the Republicans need to find someone else - but he cannot be an extreme conservative as the district has been moderate - but the new district will have more democrats.
Second the D's control the State Senate and Assy - and they just recently redrew the Congressiona lines (and NY has lost one house seat) - looks like a lot of gerrymandering. Thus a lawsuit has been filed Lawsuit asks courts to stop New York's new congressional maps | wgrz.com

This coming Saturday, I will be attending our Party committee (I am on the county and State committees) to vote on who we will nominate for Congress and as well as our State Governor and State Senators & Assemblyman.

What will you be doing to help elect good men to office?

He, like the rest of the RINOS, need to play to win. Those cowards let the election be stolen. Shameless cowards. Make SCOTUS rule on if he is required to open a slate he seems fraudulent. That's what Dems do. That's why they win.

I back candidates every election, but only fighters. No votes for RINOS.
Thankfully we have two candidates for Governor who have each vowed to politically burn Brino Kemp to the ground.

So you are saying he should have gone against the Constitution and violated his oath? Yes or no?

He should have done what the Trump legal team told him was their interpretation of COTUS and thus sent it to SCOTUS. That is how it works.

I asked a yes or no. Should he have violated his oath to the Constitution? I don't care what the Half-rate Trump legal team suggested.

Since I don't think it would have violated his oath to refuse to open fraudulent slates I see no problem. I actually think he violated his oath by opening slates he knew were fraudulent.
For the record, I don't answer yes or no. A good judge taught me that. You stop beating your wife last week? Yes or no?

So you didn't vote for Trump since he is the epitome of a RINO.

The Constitution does not give the option to not open them. The certifications themselves were not fraudulent. I 100% believe the election had massive fraud, however, it was up to the state legislatures to do something about it and they refused. There is NOTHING in the Constitution that said Pence could refuse to open them without violating his constitutional obligation. That was not his call to make.

The federal courts set up the fraud.
He could have refused to open fraudulent slates and let SCOTUS determine if he has to open them.
(snip) If he dares run, Trump will politically burn him to the ground and grind him to dust. I hope he runs.

Of course he had to open them. There is ZERO question about that. Jenna Ellis was an idiot.

He did not have to open them.
Had he not, the Republicans in Senate would not have gone on record to force it procedurally. It would have been political suicide. It would have stalled. Dems would have had to go to SCOTUS. SCOTUS would have then had to rule.

Its fine to talk about the 2022/24 election - but leave the 2020 out of it
(at least until 2075- but ask Dr Bob for permission)
