How is it that a psychiatrist can go "Postal/Psycho," killing 13 people and one fetus, and claim insanity? Only in America...only in America!

Had Hasan went "Postal/Psycho" in an Arab/Islamic nation, he would have been beheaded by now, and that would be justice served in the name of Allah!

So, can anyone tell me if they believe Hasan was truly insane when he shot and killed 13 human-beings and one fetus?

Just the fact that he was writing to internationally known terrorists; purchasing guns and stockpiling ammo; than planned and carried out the murderous acts at Fort Hood does not sound like insanity to me. It sounds more like a calculated plan by a cold hearted killer who hated America and Americans in the name of Allahu Akbar; "terror"; and all its sick, dark glory!

I'm sure he'll be tired, sentenced, and executed; that is, unless some "smoke and mirrors" slick-talking lawyer is able to "pull-the-wool-over-the-eyes" of the judge and jury. If that happens, than Hasan will probably be out on the streets in 10 to 15 years; working as a private shrink under his military/taxpayer funded psychiatric license:BangHead:

And that my friends, can only happen here in America!

Just to clarify, Hasan's lawyer for his military tribunal says that he may plead not guilty by reason of insanity. I don't think there are juries in military tribunals.

I would think that the insanity plea wouldn't be a surprise to anyone, especially since he is a psychiatrist who is well aware of the legislation around the insanity plea and the symptoms required to justify that plea.

Whether the judge buys it or not is a different story since Hassan's lawyers need to justify that he was insane during the act in question.

I don't know if he was legally insane or not but there are some facets of his history that suggest he may have been. That is for his military tribunal to decide. Either way, it is a terrible act that requires a strong response.

Writing on questionable message boards, stockpiling weapons and murdering people are all things that insane people are capable of doing. Unfortunately, mental health is an area of medicine that is often overlooked or inadequately managed in patients until it is too late, at great risk to themselves and others.

Also psychiatrists and psychologists are not immune to insanity and may be at slightly higher risk in some respects. The first psychotic patient I interviewed was a former psychologist.

He will be tried by general courts-martial under the authority of the Commanding Officer, III Corps. The court will be composed of a military judge and, because the charges are a capital offense and his plea, twelve members who must be at least of Major rank because that is Major Husan's rank. The military judge will be a JAG officer and a member of the bar.

Insanity is , no doubt, the only defense he has. This is no real surprise at all.

The good part is that in a military court, he won't get a chance to use it as a forum to air his grievances.

Let's put it this way....would any SANE person kill 14 people?

I would say it is possible.

Man is fallen after all.

Also... I God considers murder to be due to insanity there would not be a commandment against killing.

The only case Texas would have against him is perhaps an illegal purchase of the weapons involved. This is a military crime, and my guess is it will be tried by a courts-martial, under the U.C.M.J..

In a courts-martial, he will have access to representation, allowed to cross examine witnesses, and is presumed innocent.

He won't be tried by the State of Texas! Again, he will be tried by the U.S. Army. (See post number 4.)

The U.S. Army has full jurisdiction and authority for law enforcement and prosecution of the murders committed in this case.

It's the way our legal system works. While it is true that one need not be presumed factually innocent in public opinion, it is a basic principle of American jurisprudence that one is presumed legally innocent until the government proves guilt beyond a reasonable doubt or a guilty/ no contest plea.

Before the court he will be presumed innocent but, obviously, law enforcement and prosecution believes he is guilty else he would not have been apprehended and charged.
