Was he wearing anything resembling his active duty uniform? IOW, did he look to be representing the US Army? If, so, call him back for a courts martial. If not, let the civilian courts handle his case.Should he be recalled to active duty for court marital?

To me that should only be applicable if it was for something that the retiree did while still in uniform.I'm proven wrong...again.
I disagree with the decision, though. If I commit a crime while not under UCMJ it does not seem right to call me back to duty and charge me with a violation under UCMJ.

OH! Actually @JonC you and I are wrong. The law is pretty clear they are subject to the UMCJTo me that should only be applicable if it was for something that the retiree did while still in uniform.

Pfffft! That's nothing! Vote ME in for POTUS and I'll pass an EO making Mondays illegal along with a ban on all non-essential business before 12 noon. Beer & pizza half price for all vets along with everything else sold at wholesale price with no sales tax to combat vets.When I am President I will change that.
