I think the gist was to confirm between the election and her first day in office.

I reckon the bigger question is could Obama withdraw him from consideration before the Senate could consent.

If he/she has not been confirmed, I don't believe so. However it is very likely they would select similar leftist idealogues. So maybe she would just go with whatever leftist Obama picks.
