Supreme Court Strikes Down Texas Abortion Clinic Regulations

WASHINGTON — The Supreme Court has struck down Texas' widely replicated regulation of abortion clinics in the court's biggest abortion case in nearly a quarter century.

The justices voted 5-3 Monday in favor of Texas clinics that protested the regulations as a thinly veiled attempt to make it harder for women to get an abortion in the nation's second-most populous state.

Justice Stephen Breyer's majority opinion for the court held that the regulations are medically unnecessary and unconstitutionally limit a woman's right to an abortion.

Texas had argued that its 2013 law and subsequent regulations were needed to protect women's health. The rules required doctors who perform abortions to have admitting privileges at nearby hospitals and forced clinics to meet hospital-like standards for outpatient surgery.

Breyer wrote that "the surgical-center requirement, like the admitting privileges requirement, provides few, if any, health benefits for women, poses a substantial obstacle to women seeking abortions and constitutes an 'undue burden' on their constitutional right to do so."

Justices Anthony Kennedy, Ruth Bader Ginsburg, Sonia Sotomayor and Elena Kagan joined Breyer.

Chief Justice John Roberts and Justices Samuel Alito and Clarence Thomas dissented.

I don't get it. Something that would have been an added protection for women, is called an undue burden.

Abortion.—In Roe v. Wade,557 the Court established a right of personal privacy protected by the due process clause that includes the right of a woman to determine whether or not to bear a child. In doing so, the Court dramatically increased judicial oversight of legislation under the privacy line of cases, striking down aspects of abortion-related laws in practically all the States, the District of Columbia, and the territories. To reach this result, the Court first undertook a lengthy historical review of medical and legal views regarding abortion, finding that modern prohibitions on abortion were of relatively recent vintage and thus lacked the historical foundation which might have preserved them from constitutional review.558 Then, the Court established that the word "person" as used in the due process clause and in other provisions of the Constitution did not include the unborn, and therefore the unborn lacked federal constitutional protection.559 Finally, the Court summarily announced that the "Fourteenth Amendment's concept of personal liberty and restrictions upon state action" includes "a right of personal privacy, or a guarantee of certain areas or zones of privacy"560 and that "[t]his right of privacy . . . is broad enough to encompass a woman's decision whether or not to terminate her pregnancy."561

With four Liberal Activist judges on the Supreme Court, four judges are a guaranteed pro-abortion vote, regardless of constitutional merits of any given case.

We have four judges who don't care even a little what the Constitution says, nor do they care even a little for our religious freedom. Elect Hillary and she'll make it five, ending America as we know it (okay, America as we know it has already ended).

Yeah because when I go to an outpatient surgery center, I'm going to be happier that they are NOT associated with a hospital, the doctor has no admitting privileges (umm - why not??) and that it's standards can be lower than a hospital. Really?? Seriously? Those were the standards I had for my gastroenterologist to have for doing my colonoscopy!! Why not an abortion too? "Rare and safe" is the mantra of the pro abortion people. How does making sure there are medical standards to be met keeping women safe? Can you say Dr. Gosnell?

Thank you Salty1 I also no not see where in the Constitution women have the right to an abortion. Back then, it would've been unthinkable, an abomination for a women to terminate a pregnancy

Now we have the Republican leadership rooting for Hillary, the most pro-abortion candidate in US history, and one with an unprecedented opportunity to shift the Supreme Court all the way to the Left wall. After Jan 20, 2016, conservative cases will have snowball's chance in Hell at the Supreme Court.

And we have the presumptive "republican" nominee who praised planned parenthood and then recently wanted to raise 10 million dollars for abortion aka women's health. And evangelicals are fawning over him. So no this is not a surprise. Thanks to Trump supporters abortion will go unchecked in this country.

When you good replies to your posts, you double down on insanity. Nothing personal. Just human nature. So, I expect you to just blow off the fact that Trump has provided a list of highly respected conservative judges that he would nominate. You think Hillary will do better with whatever Ginsburg clone she can find.

I don't know anything about trump raising 10 million dollars for abortion. I googled and found no evidence Trump ever donated a penny to abortion, or Planned Parenthood. I even checked the most anti-Trump publication on the planet.

Trump said nothing about abortion. Women's health can include many things other than abortion, such as breast cancer treatment and healthy pregnancies. He chose women's health issues because in a debate with Bernie, he'd be trying to win Bernie supporters.

I don't believe for a second that Trump would give the money from the debate to any abortion cause. Trump never has in the past and has been consistent in being pro-life in recent years.

But, your candidate, Hillary, is proudly a champion of abortion, and she wants to force Catholics and Christians to help provide abortions.

We all know what womens health means. It is code for abortion. So you have to deal with the fact that your candidate is pro choice. My candidate Cruz, possibly Castle is Prolife. :)

You do realize that more you throw adhomine attacks the more you reinforce my ideas about Trump Supporters and my #NEVERTRUMP stance. Just a friendly FYI.

Planned Parenthood does lots of things for women's health, it's true. But they derive 75% of their revenues from doing abortions. So if you say Planned Parenthood does good for women, you are saying that it is possible because of abortions. No abortions, no Planned Parenthood.

Probably in that section that talks about marriage being limited to a man and a woman.:eek:

Point being that some of you seem to be cherry picking about what needs to be in the Constitution in order to designate that someone has a Constitutional right to.
