I think that misses the point. Police are not now allowed to barge into any house they'd like. Certain questions have to be asked and answered before the warrent is issued, right?

I believe with the Patriot Act they still need to go before a panel of judges to get approval. I guess I could be wrong.

Was it the 90% thing? If so, you said that if you have a search warrant issued on you, that the odds are 90% that you have already violated someone's rights. I took that to mean that 90% of those are convicted of doing so. That is how I got to that point, and you thought I was being evasive or dishonest. I guess I missed your point. I understand what you said, I just don't get your point. Perhaps the fact that I have only slept for 5 hours total in 3 days has something to do with it, but tell me what I am missing here?

Maybe it's not an either or situation. I think we should protect the well-being of innocent people, such as victims, as well as prostituting criminals. I don't, however, think we should be quick to give up our rights and assume that the police will always do the right thing.

In my opinion, most of the problems with criminals getting away with crime is due to inept judges, not handcuffed police officers.

Isn't that a bit much??? As much as I am a law and order guy, I think prostituting even the worst criminal is probably over the line. :D On the other hand, I would be in favor of prosecuting criminals.

An interesting commentary on this issue that begins thusly:

The poorest man may in his cottage bid defiance to all the forces of the Crown. It may be frail – its roof may shake – the wind may blow through it – the storm may enter – the rain may enter – but the King of England cannot enter – all his force dares not cross the threshold of the ruined tenement! - William Pitt

Finally, a good article from Lew Rockwell.com. It's about time, after all the nonsense he has posted over the past years. Rossi explains the ruling in a clear way and made a great case for it.

As he says, While the prohibition essentially remains in form,. As I said early on in this discussion, the prohibition is still there. What has changed is the escape clause that criminals use. We live in a society where criminals like police misconduct because it allows them to commit crimes with impunity. It is high time that the SC stood up against this nonsense. Hopefully, this is a step forward towards the elmination of the "fruit from the poisoned tree" foolishness that has allowed far too many guilty people to roam our streets to commit crimes again.

When a police officer breaks the law, punish him. Don't let the criminal off.

The only stunning part of this decision is still that four people charged with upholding law and order voted not to. How in teh world? What were they smoking?

In other words, all the teeth have been pulled from the prohibition. There is little consequence for that law not to be followed.

    Bottom Line

We can say that nobody we know has actually lost their rights in a real sitution. In reality: What is occuring is that the stage is being set for all rights to be lost in one day sometime in the future when evil takes control of the reigns of Homeland Security.

I'm certain many people even mean well, when they say they want to only capture terrorists, but history has shown us that the lack of freedoms always results in destruction when those hungry for power get in a position to use their new-founded freedoms of attacking a person's privacy.

We are in for a hard and bumpy ride.

Amen! People don't realize that even if the current regime was benign, (and I don't think it is), the infrastructure for totalitarianism is being established.

So anyone who disagrees with how five of the justices voted is not for upholding law and order? So anyone who disagrees with how five of the justices voted is smoking something?

    What an argument.
