there's more, but you get the gist. There's never been a ruling on jus soli, that Kim one just claimed some Chinese guy born here to two LEGAL immigrants was a citizen, and that other one was some 5-4 decision that said we had to let illegals attend public school, read the dissent. I think jus soli is enough, but some clarification could help = I'm reading the 14th literally but hope there is an EO in the future - it will be stayed ASAP and appealed up to SCOTUS.

All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.

From Article 1: This has nothing to do with providing congress or executive order being able to change the 14th ammendment. This is a statement of who are citizens. If you are having trouble understanding what it means, it could have been written as such; "All persons born or naturalized in the United States, US embassy, US territory, or any other location that comes under the jurisdiction of the US government."

In other words "under the jurisdiction thereof". Hope that helps.

Which meant that Sen John McCain was born a natural US citizen even though he was born in Panama since the military base is under the Jurisdiction of the USA>

BUT suppose he had been born in non-military Panama civilian hospital?
 
I don't know much about McCain or his family, but my understanding is you are a citizen if one of your birth parents are. I could be wrong.

A person born abroad in wedlock to two U.S. citizen parents acquires U.S. citizenship at birth under section 301(c) of the Immigration and Nationality Act (INA), if at least one of the parents had a residence in the United States or one of its outlying possessions prior to the person's birth.

Current law is, imu, that if one parent is a US citizen the child is a a U.S. citizen regardless of where they are born.

When McCain was I believe the laws were different. If both parents were US citizens then yes, no matter where they were born. If only be parent was citizen, then the parent must be 21 years old. It was changed in the early 1960’s.

I have a friend who was born in the Netherlands- Her dad was on USAF duty - and her mom (his wife) were all there. Though Anita is a US Citizen - she also held citizenship in the Netherlands.

There are several soccer players who have dual citizenship because of the same situation. They are free to choose which national team they play for but forbidden to change once they play in a match.
