This is a bit off OP - BUT

This past week in Syracuse, a women was found dead in her vehicle as well as her three children -
evidently it was a case of murder/suicide.
Later in the week, I read where the father was preparing to go to court to enforce his visitation rights. :(:Cry

The definition of manslaughter varies from state to state. It could be considered manslaughter if he had no premeditated malice. That's going to be hard to prove since when the father caught up to him he immediately started to beat him up. Presumably, the father was thinking he was going to put a beat down on this guy as he was chasing him down.
The assault was premeditated, but from the article it seems like intent to kill would be tough to establish - maybe depraved indifference. And the fact that bystanders joined in muddies the water even further. The autopsy report would also be critical - did the carjacker have some pre-existing health issue that made him especially vulnerable to the assault but wasn't discernable to the father?

For the sake of the kids, their abductor (who could have been armed) was necessarily rendered unable to continue his crime or escape to commit another. It was about an hour from the time he kidnapped till he was pronounced dead. A lot of unknowns from the story to say which heroic citizen, if any, should be charged with what for stopping him permanently.

However, by leaving the children alone as she did, the mother (one was hers) is guilty of child endangerment and probably deserves to be charged. Unfortunately, she provided a kidnapper easy opportunity. A very bad decision on her part. Maybe she learned a valuable lesson in time.
