British Pensioner 78, Arrested For Murder Against Home Intruders

According to the UK Daily Mail, a 78 year old pensioner was arrested on suspicion of murder after stabbing an armed intruder to death in his own home. The pensioner was upstairs asleep with his wife when he was woken by the two men breaking into his suburban home in Hither Green, south-east London last night. He was forced into his kitchen by one of the men, who was armed with a screwdriver, before a struggle ensued.

The intruder, a 38-year-old man, was left with wounds to his chest and local residents say he collapsed in a neighboring road and died in hospital.

Good grief, the man should be hailed as a hero for fighting back and protecting his elderly wife who was also at home, but in today's England he gets arrested on the charge of murder. It's SELF DEFENSE you idiots, not murder!

We arrested a man here in rural Georgia for home invasion burglary. The owner of the home held him at gunpoint until we arrived. At sentencing, the judge threw out the plea deal and threw the book at the intruder. Judge told him, "I don't like how this turned out. I wish he had shot you dead instead of waiting for the Sheriff. If you broke into my house, I promise you I would have killed you."
Difference between rural Georgia mountains and Commie land is obvious.

...he must be in pretty good shape for a 78 yr old man, or grew up having to be mean as a junk yard dog like my 93 year old Dad, who would definitely shoot first and ask questions later. A fight like this is 90% attitude.

Relax. Routine procedure here where there's an unexplained death. It's part of the post-death investigation process. The pensioner will be released without charge almost certainly. Usual Daily Heil dog whistle tactics

Arrest is not what you do to an innocent man. If y'all intentionally arrest innocent people, I am glad we threw off your tyrany.

An absolutely stupid post. Don't forget the USA is a republic and republics are commie as you put it. Secondly, unlike you, we are a law based country. You have to prove that you have used "legitimate force"

IF it goes to court he will probably be found not guilty, depending on the evidence. But if `someone is killed in such circumstances their has to be an investigation.

There will be outrage if he is convicted and he will eventually freed.

Typical of England. "Guilty until you can prove you are innocent."

The only government on the planet that is worse is, well, maybe Uganda, or one of the SA banana republics.

I'm telling you, that is what I thought - the man sure had plenty of fight in him at the age of 78.

We are a law based country also and in most jurisdictions a person defending their home will certainly be questioned, but not arrested. Plus, there are not many prosecutors who would put a man on trial for defending himself and his wife in his own home. Unfortunately, there are a few states where a person could get arrested and charged like this guy was, but in the majority of jurisdictions there would be no arrest or charges.

Why do you say a republic is "commie"?

We are a Constitutional Republic. Nothing Communist about that. You arresting people and making them prove innocence is stupid.
We investigate all shooting deaths as well. We are a nation of laws, but unlike you we do not arrest people until we conclude our investigation and determine a crime was committed.

Under law, the police cannot question him unless they arrest him; those are his rights. It's all part of Due Process.

How do you know he's innocent? Picture the scene as the policeman who is first there: a man is dead or dying on the ground with another guy holding what appears to be the murder weapon. What do you do - just let the guy walk away?

He can't be questioned unless he's arrested under UK law. The police here aren't allowed to just randomly interrogate their fellow citizens without obeying the law.

I work a death scene and interview witnesses. No arrest needed. Actually, no probable cause for an arrest exists in the case of most home invasions. Our laws are pretty clear, if you enter a home in a "violent or tumultuous manner" then legally you are a dead man walking.

So, you lock them up for breaking no law and interrogate them.
Just so you understand U.S. law a little better, we can only interview or interrogate a person with their consent. They can say don't want to talk, I am done talking, and it ends there.
