Chief Justice and the Impeachment

Chief Justice John Roberts will not lead Trump’s impeachment proceedings against the Senate.

It has previously been reported that Roberts was dying to avoid leading Trump’s bogus impeachment because he didn’t want to become a political lightning rod.

Pro Tempore Senate President Pat Leahy (VT) will instead lead the mock trial.

JUST IN: Chief Justice Roberts will not lead the impeachment process against Trump Senate - Bourbon Street Chronicle

Apparently, since Trump is no longer POTUS, the Chief Justice is not required to fullfill that role.


So, should Roberts fill that seat?

If Trump can undergoe a presidential impeachment then I would say yes, because it is still impeaching a President.

If this kangaroo court of an impeachment trial is going forward, the Constitution requires the Chief Justice to preside. Of course, they have ignored the Constitution up to this point, so l don't expect them to suddenly adhere to the Law of our Land now.

A private citizen is being impeached, not a president.
But a presidential impeachment is to remove the President. If the Senate can try a past-President for impeachment under the violations the Constitution gives for a Presidential impeachment then he should be tried as a President being impeached.

Truth is this is all political and is reaching.

Hopefully, the defense will file a motion with Supremes to dismiss as unconstitutional.

A private citizen is being impeached, not a president. Maybe they will impeach you or me next.

No - A Sitting President was impeached (which is similar to a Grand Jury). But the actual trial is for a former President.

The Constitution offers only four points about the Senate impeachment trial of a president: (1) The Senate “shall have the sole power to try all impeachments”; (2) when sitting as a court of impeachment, senators “shall be on oath or affirmation”; (3) conviction of any accused officer requires “concurrence of two thirds of the members present”; and (4) when the president is the accused, “the Chief Justice shall preside.”

I guess it could go either way as the Constitution seems to allow for people to be impeached after they have left office, but is this still impeaching a President? Also, impeachment of a President is a little different....if former President Trump can be impeached it seems that he would fall under a presidential impeachment.

Personally, I think they are just making up their own rules now. It's like playing Risk with a five year old.

Good point @Salty . Former President Trump was not impeached as a former President but as a sitting President.

About the only thing that the Senate can do now - is to take away Trumps right to run for federal political office - but that could only happen IF he is convicted -(by 2/3) - which appears to virtually impossible now. -- Lets see - Congress has now impeached a President four times. Looks like their record is going to be 0-4!

Its all moot as they dont have the votes to convict.

And the Dems know it - The only thing I can figure is that at the next re-election for those Senators - the Dems will complain that they voted against the conviction.

He’s already said he will not preside.

That means the trial of the “president “ cannot go forward.
If , if he is tried it will be as a “former president”, a private citizen, presided by the Vice President.
A vice president who has revealed her presuppositions thus showing partiality. She cannot be independent/non political/non bias.

This is embarrassing. A leftist, Stalinist act of hunting down, pursuing and punishing your political enemies.
