Graham's interpretation of the Constitution is highly political

President Barack Obama has violated the Constitution on numerous occasions. Obamacare, executive orders, cybersecurity, NSA surveillance, backdoor legalization of illegal aliens, the Pakistan drone war and the invasion of Libya are all serious constitutional violations.

On Wednesday South Carolina Senator Lindsey Graham warned that he and his fellow lawmakers will call for Obama to be impeached if the president releases more detainees from Guantánamo Bay without congressional approval.

Article II, Section IV of the Constitution provides Congress with the vehicle to impeach a president for high crimes and misdemeanors.

“It’s going to be impossible for them to flow prisoners out of Gitmo now without a huge backlash,” Graham said. “There will be people on our side calling for his impeachment if he did that.”

Lindsey Graham’s interpretation of the Constitution is highly political. In 2010 he opposed states’ right by stating Arizona’s immigration law was unconstitutional. He has supported the unconstitutional wars in Iraq and Libya.

Graham and Republicans in Congress insist Obama broke the law by releasing the Taliban detainees from the Guantánamo facility in exchange for Sgt. Bowe Bergdahl. The law in question is the National Defense Authorization Act for 2014 signed by Obama.

In 2006 the Supreme Court ruled 5-3 that the military commissions system established by Bush and his neocons was unfair and illegal.

Yep that makes him a crook in a crooked government then doesn't it?

I have to :laugh: every time the republicans try to act tough for the cameras.

They aren't going to do anything about Obama's criminality. If they did their own criminality and hypocrisy would be that much harder to hide. Talk is all we'll get from republican hypocrites when ever the democrat hypocrites violate the law.

And vise versa.

All this talk makes me want to run for public office. I'd never get elected though. Firstly, I don't have enough money. Second, I am too conservative.

Since no president, no matter what has ever been impeached and then removed from office we have already seen that it is a very difficult process to accomplish. This president would not be impeached, convicted, and removed from office no matter what his skin colour. After all, President Jefferson wasn't even impeached for buying Louisiana without Congress' approval. He broke the law and stayed in office. President Clinton was impeached, but not removed, despite the fact he openly perjured himself in court.

That's technically correct, but from a practical standpoint inaccurate. Nixon's articles of impeachment were passed by the House 403-0. He would have been convicted in the Senate if not for his resignation.

This "president" has repeatedly broken, ignored and altered the law illegally. Yes, he can and should be impeached, but with his communist cadre in control of the Senate, you're right, he could be convicted. That may change, however, after the November 4 elections.

Again, incorrect. One, he had Congressional approval for the purchase based on the treatment of the territory as a colony, and on Jefferson's right as president to execute treaties -- and purchase was a treaty -- with Senate approval. Of course he stayed in office, since he didn't break the law, although I'm sure you can find a number of websites out there who pretend to analyze the purchase and conclude that he did. The fact is, the political atmosphere of the first 50 years of our nation was volatile, as even the framers of the Constitution had to figure out what a constructionist view actually allowed while allowing their own political agendas to cloud their interpretation.

Well, of course not! For the same reason the Little Marxist Dictator can't be impeached under the current makeup of the Senate. Though the Republicans had a ten-seat majority, the polarization of political parties in this nation prevents an objective view of evidence in such cases and forces votes along party lines.

However, the heinousness of this "president's" crimes, once exposed, will force Democrats to take appropriate rational action or risk being permanently marginalized if not becoming irrelevant -- or even extinct.

No. But they might impeach him if he wasn't black.

As it is, he is unimpeachable.

I like the way you added "convict him" to the parameters of my statement, but it didn't change, or even challenge, my contention.

No matter what law he breaks, he is unimpeachable. Because he's black.

Seems like both sides are capable of 'playing the race card'

The Republicrats have to much at stake today to go impeaching each others guys. They don't want to rock the boat too much because they know the shoe will one day be on the other foot.

Could be, but it doesn't change what's going on today. Obama continually breaks the law and gets away with it. He won't be stopped or impeached because of the color of his skin.

Pitiful but true.

The GOP don't have the same power now as they did. This man would not be impeached over this no matter what colour.

However, you got me to thinking. If Clinton had not been impeached Obama might have been more liable to.

And he would never be convicted anyway.

I heard a GOP Congressman just hours after Bergdahls release say, "We need to make tougher laws on how a prisoner is released". That is hilarious because Obama will just break that law also. The GOP never learns the liberal way to play the game, CHEAT!
