Proud Boys Charged with Sedition in Capitol Attack

Enrique Tarrio, the former chairman of the Proud Boys, and four other members of the far-right group were indicted on Monday for seditious conspiracy in connection with the storming of the Capitol last January, the most serious crime to be charged in the Justice Department’s sprawling investigation of the assault.

The sedition charges against Mr. Tarrio and his co-defendants — Joseph Biggs, Ethan Nordean, Zachary Rehl and Dominic Pezzola — came in an amended indictment that was unsealed in Federal District Court in Washington. The men had already been charged in an earlier indictment filed in March with conspiring to obstruct the certification of the 2020 presidential election, which took place during a joint session of Congress on Jan. 6, 2021.

Another Proud Boy lieutenant originally charged with the men, Charles Donohoe, pleaded guilty in April and is cooperating with the government’s inquiry into the group. Around the time of Mr. Tarrio’s arrest this spring, federal investigators searched the homes — and seized the phones — of three other high-ranking Proud Boys identified as unindicted co-conspirators in the case, but none of them have been publicly charged.

A charge of seditious conspiracy requires prosecutors to prove that force was used either to overthrow the government or to interfere with the execution of federal law.

This shouldn't be difficult to prove. The objective of the Jan. 6 rebellion is widely recognized as being to interfere with the federal law concerning validation of the election results by the Congress and Vice President.

Wonderful. The defense will get to depose everyone involved: including government oficials/informants, capital police officers, etc. and tell their side. If guilty, they deserve the consequences.

Let’s hope truth and justice marks the outcome, whatever it is.

God willing, this could work out in the Patriots favor.

18 U.S. Code § 2384 - Seditious conspiracy

In brief, to prove their case, Federal prosecutors have to prove the alleged seditious act was directed against a lawfully elected government.

The Proud Boys held without bail should consider a pretrial writ of habeas corpus so as to get that out of the way.

Given the election was corrupt, criminal and a violation of our Constitution. So too was the failure of a complicit VP when confirming those votes.

This could be very interesting if justice really does prevail here.

I went to the Capitol in 5th grade back in 2005 - the only way people are getting in there (especially at such a time as the 2021 inauguration) is by shooting their way in, they'd have to have some heavy artillery too. The whole thing is a joke, they were let in (per video recording). The real victims are the people who have been held for a year on bogus charges and/or sentenced to ridiculous amounts of time.

I know a soldier who retired from the Marines and then joined to serve in the National guard.

He was there to witness Capitol police opening the barricades to allow ANTIFA in after they arrived in private fleet busses.

He said the protest was peaceful till their arrival.

If you look at the video when they entered the Congressional building, these violent radicals bent on Sedition, you'll see them walking a red carpet. And remaining within the area demarcated by velvet ropes.

It was all a set up. The radicals arrived to cause chaos and for one purpose. To blame it all on Trump. And distract us from paying any more attention to the steal itself by conjuring an aftermath theater of chaos intended to imply the vote was lawful and Trump and all Conservatives were a sore loser.

It spread like wildfire initially, chapters opening everywhere on the planet. Governments have always been terrified of men coming together with common purpose and values, that’s why they always infiltrate those groups, whatever they be.
To the elites this group had all the hallmarks of the thing they most feared, loss of control. Can’t have tens of millions of men expressing that western values are the best. The elites have been spending their whole lives selling the opposite message, they instantly saw the proud boys as counter revolutionary.

Governments did nothing to suppress antifa which was far more violent but Governments saw Proud Boys as an snowballing monster that was the reaction to antifa. getting away from them.
Antifa clearly was seditious, murderous and destructive, but they have not been brought to account. Antifa was working to the elites purpose.

Governments see that large groups of men need to be broken up, men are extremely dangerous in the governments eyes, always will be.
Men make great slaves, but are terrible masters in their eyes.
Women’s groups they don’t care about, men bring about serious change when they gather in large zealous numbers.
If you had a million men in a knitting club, it will be infiltrated immediately by government agencies, meta data gathered, phones tapped, leadership identified and profiled.
Oath keepers, promise keepers, militias, bikers, all governments are extremely sensitive to their growth and who is in charge of them. They infiltrated them all, even if no crime has been committed to warrant an investigation.
The full power of the media labelling them as racist and the state was always going to be brought to bare on the Proud Boys, they were so terrified of them they are charging them with death penalty offences to scare men in future from organising.

The coffee houses of yesteryear were closed down, because governments saw in them a place where men were gathering and communicating and this could have lead to plotting and sedition.
I could cite many other examples of the governments continuing war on men and their demoralisation, but you probably know them already.

Every effort is made to prevent mass organisation of men outside of government elite control.
Part of the unveiling is the general realisation of this fact.

No evidence had been produced by anyone even hinting that this was not a fair election. Trump lost ALL his bogus attempts to reverse the results in the federal courts. If you want to form a new nation under Trump go ahead. Good luck.

I disagree that they would have to prove the group acted against a lawfully elected government as the government in place had been there for almost 4 years.

From what you post, it seems all that would have to be shown is that they interfered with the execution of 3 U.S. Code § 15 . . . which they did.

Is that all they need to prove...that they used force to interfere with the execution of federal law? Seems that's cut and dry.

I was picturing the government allegedly elected in November as I wrote that. EyeZ a genius.

Wow, you’re not even waiting for a verdict, or presuming Innocence. Don’t hold to extreme ideologies over what is right and just.

I pray they're never called to jury duty.:(

I watched a murder trial on a court tv channel last year. The verdict was guilty even though there was enough reasonable doubt to warrant acquittal.

A reporter interviewed one of the male jurors. She asked what evidence cinched the verdict as far as he was concerned.

This juror said,and I quote, well if he wasn't guilty they'd (the state prosecutors) never have brought the case.

I hope the defense heard that. Talk about grounds for appeal.

I think they (the courts) need to take a step back and ask what they are trying to accomplish.

Did they (the people involved in the Jan 6 riots) interfere with the execution of a federal law? Yes, of course they did.

But I don't think their intent was more than protest.

They took it too far, many probably influenced by mob mentality.

Sometimes the rule of law needs to be tempered with common sense and the decency to move on.
