So Gianforte did grab the reporter, he did throw him to the ground, and he did punch him.
Well, maybe. Now she says, "just on each side of his neck, just grabbed him and I guess" she guesses, "it could've been on his clothes, I don't know." She doesn't know.

This is going to degenerate into "he said, she said." The campaign has already stated that the reporter grabbed him by the arm first and that he was only defending himself.

I doubt we will ever know the full story.

But I can't wait for the polls to close so we can see what happens! :D

Main point is that he physically attacked the reporter, not what grip he used to throw him to the ground.

Sent from my Motorola Droid Turbo.
Last I heard, it has been walked back to the point of "they both fell to the ground."

Gianforte is up by 5% and the rural counties are starting to come in which always go heavily Republican.

Quist is winning Blaine county, which usually goes heavily Republican. This thing may not be over.

Ok. It's getting close to being over. This story either had no effect, or a positive effect on the election for ole Greg Giantbodyslam.

With 77% of the votes counted Gianforte is ahead of Quist by 6 points.

Left wing loons lose again.

He lost some counties he should have won but those he did win he won with 70 or 80 or even 90%. Those are big numbers for a challenger to overcome. Especially a challenger with no money to speak of (Gianforte is a billionaire) and whose only claim to fame was as a folk singer back in the 1970s.

And I blame Obama for that nonsense.....it serves to make people feel ...well, I will allow you to extrapolate. But I would love for Trump to eliminate that nonsense.

I don't give Barry all the credit. The "forms" were designed long before he existed. However, he was instrumental in adding fuel to the fire.

Battery need not follow a threat. In this state, Assault is not an element of battery, but it can be a lesser included offense of battery..

Every state has their own codes. And your state does not apparently go by the general rule of thumb of threat before battery charge. I think Gianforte's charge according to Montana state law, was misdemeanor assault.

I will give you an example of battery without a threat. A person walks up to a stranger on the sidewalk, sucker punches him, and knocks him out. I arrested someone for that. When e.r. called me r
To tell me he had a concussion, charge was upgraded to aggravated battery.

"Assault and battery have typically been treated as separate, but related, crimes. However, in some states the definition for one or both of the crimes has changed over time, and in some places the two have been combined into a single offense."
State Assault and Battery Laws - FindLaw

"An assault is:
  1. An unlawful attempt, coupled with apparent ability, to commit a violent injury on the person of another; or
  2. An intentional, unlawful threat by word or act to do violence to the person of another, coupled with an apparent ability to do so, and doing some act which creates a well-founded fear in such other person that such violence is imminent.

A battery is any:

  1. Willful and unlawful use of force or violence upon the person of another; or
  2. Actual, intentional and unlawful touching or striking of another person against the will of the other; or
  3. Unlawfully and intentionally causing bodily harm to an individual."
